NOTICE OF VIOLATION /85-52 This refers to a telephone conversation on September 26, 1985 between Edwin A.

Wurtz, Ph.D. of this office and Darwin Taras, Chief, Health Physics, Safety Office, U.S. Army Material Command. During this conversation it was brought to our attention that you are in possession of a Radiflow device containing less than 9.5 millicuries of Krypton-85, a radionuclide licensed by the Nuclear Regulatory commission.

Further, we understand that you are making efforts to dispose of the above mentioned device within three months of the present date.

Possession of the above quantity of Krypton-85 without a byproduct material license is a violation of Commission regulations as set forth in the Notice of Violation, enclosed herewith as Appendix A.

This violation has been catego-rized by severity level in accordance with the revised NRC Enforcement Policy (10 CFR, 2, Appendix C) published in the Federal Register Notice (47FR 9987) dated March 8, 1984. You are required to respond to this letter and in pre-paring your response, you should follow the instructions in Appendix A.

In accordance with Section 2.790 of the NRC's " Rules of Practice", Part 2, Title 10, code of Federal Regulations, a copy of this letter and your reply will be placed in the Public Document Room.

The responses directed by this letter and the accompanying Notice are not subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.
