Dear Mr. Linder:

In response to your letter of February 26, 1985, which transmitted Dairyland Power Cooperative's response to our letter of January 15, 1985, concerning the use of armed responder for compensatory duties, the Division of Safeguards, Office of Nuclear Materials Safety and Safeguards and the Division of Licensing, Office of Nuclear Reactor Regulation have reviewed your responses and have made the following determinations:

1. ._ Members of the response force may be allowed to have other duties, but their primary duty must be response and any other duties may be undertaken on a non-interference basis with their response duties and must be duties of a nature that could be immediately abandoned without degrading the level of protection.
2. The licensee must be able to demonstrate by a logical analysis or actions that the criteria identified above are met by the licensee in using armed respr,nse personnel for compensatory postings or other comparable duties.
3. The provisions of 50.54(x) and (y), which allow the suspension of safeguards-during emergencies, are not limited to only Site Area or ,

general emergencies.

4. The provisions of item 1 above do not represent backfit and, therefore, the provisions of the backfit procedures do not apply.
