(1) Docket 70-143; SNM License 124 (2) Report No. 70-143/85-44 dated 1/16/86 Gentlemen:

In response to Reference (2), the attachment to this letter is submitted, stating:

(1) admission or denial of the alleged violation; (2) the reasons for the violation if admitted; (3) corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Since a disclosure of the information contained in the attachment to this letter would tend to weaken the safeguards and security measures and is deemed commercial and financial proprietary information within the intent of 10 CFR 9.5(a), it should be withheld from public disclosure under the provisions of 10 CFR 2.790(d).

Alleged Violation License Condition 2.1 of Safeguards Amendment SG-1 to Special Nuclear Materials License No. SNM-124 requires that the licensee follow his approved FNMC Plan. Paragraph 4.5.2 of his approved FNMC Plan requires that, when measurement control points fall between the 0.05 and 0.001 control limits, the investigative and corrective actions shall be documented within one week.

Procedure NFS-ACC-06, Revision 5, dated July 1984 entitled SNM Measurement Control Limits requires that all investigations should be completed and documented, approved by the appropriate supervisor and reported to the Safeguards Group within one week of the occurrence.

Contrary to the above, on four occasions during the period October 11 through November 27, 1985, investigation reports documenting responses to out-of-control conditions at the 0.05 control level were not completed within one week of the occurrence as required.

This is a Severity Level V Violation (Supplement III).

NFS Response (1) Admission or Denial of the Alleged Violation NFS concurs that the investigation reports were not completed within one week of the occurrence as required.

(2) The Reasons for the Violation if Admitted The area supervisor inadvertently failed to complete the repcrt within one week of the occurrence.

(3) The Corrective Steps Which Have Been Taken and the Results Achieved Area supervisors were reminded by memo dated December 13, 1985 of the requirement to complete out-of-control investigation reports within one week of the occurrence.

Since the memo reminder there has been timely documentation of all out-of-control investigation reports.
