(Uranium Enrichment) o MOTION FOR EXTENSION OF TIME TO FILE INTERVENORS' RESPONSE TO LICENSEES' MOTIONS FOR

SUMMARY

DISPOSITION AND MOTION TO AMEND THE PROPOSED SCHEDULE FOR HEARING Intervenors, the Center for Nuclear Responsibility and Joette Lorion, hereby motion that this Board grant a 30 day extension of time within which Intervenors Responses to Licensees' Motions for Summary Disposition in the above captioned proceedings may be filed, to and including March 19, 1986.

In support of this motion, Intervenors list the following following factors for their late filing as required by Rule 2.711 (a) to show that the good cause requirements are met:

1. Joette Lorion, party who has provided research and technical assistane in this proceeding and is acting as a petitioner pro se, was hospitalized in January. This illness caused delays in another Licensing Board Proceeding, ASLBP No. 84-496-03 OLA. These delays have caused Ms. Lorion to be unable to concentrate her attention on the Spent Fuel proceeding.

2. Granting of this motion will not hardship the parties because a hearing schedule has not yet been adopted by this Board and because the license amendments in question have been granted.

Intervenors would also like to motion pursuant to 10 C.F.R. 2.711 (b) that this Board amend the proposed hearing schedule by extending each deadline by 30 days. Intervenors wish to make known to the Board that when they agreed to Licensees' proposed schedule, they were under the imprassion that the Vessel Flux Reduction Proceeding would be over on or about December 10, 1985. Intervenors were not aware that further work responsibilities would be required of them.

Ms. Lorions illness and the delay it has caused in both her personal workload and the Vessel Flux proceeding necessitates this request by Intervenors. Mitzi Young, Counsel for the NRC Staff has indicated that this change in the schedule would not be objectionable to her as long as it does not interfere with appearance of her witnesses.

Therefore,Intervenors request that this Board extend the time withing which Intervenors must file their response to Licensees' motions for summary disposition; and ask that this Board also consider a 30 day extension of time to the proposed deadlines in the Licensees' Proposed Schedule for Hearing.
