Dear Ms. Trovato:
This letter is to confirm a meeting between you and other Environmental Protection Agency (EPA) staff and Nuclear Regulatory Commission (NRC) staff at NRC Headquarters on April 21,1997 at 2:00 P.M. in the Advisory Committee for Reactor Safeguards conference room (TWFN 2-B 3). The purpose of the meeting is to discuss the NRC's Draft Final Rule on Radiological Criteria for License Termination, SECY 97-046A, which parallel's EPA's draft radiation site cleanup regulation, proposed for inclusion in 40 CFR Part 196. This meeting is intended to accommodate EPA's request for additional meetings on this topic and to further cooperation between our two agencies. Since we have had a long history of interaction on the cleanup standards issues, this meeting is not viewed as required by the terms of the 1992 Memorandum of Understanding between NRC and EPA. A proposed agenda for this meeting is enclosed. Please note that a notice of this meeting will be provided to the public, the meeting itself will be open to public observation and all documents exchanged at the meeting will be made available to the public.
The Commission has asked the NRC staff to report on the results of the April 21 meeting and provide a summary of EPA's comments, including areas of disagreement, by April 28,1997.
The Comnnssion has indicated, if requested by EPA, a willingness to meet in a public forum with an EP A policy level Presidential appointee to allow EPA to address the Commission itself on EFA's concems associated with the proposed rule. The Commission has requested that such a meeting, if mutually agreed upon by NRC and EPA, take place on or before May 9,1997, so as not to delay the Commission's vote on the final rule.
As noted above, we have held numerous discussions between EPA and NRC regarding radiological criteria for decommissioning. These discussions have included the joint rulemaking effort, the Risk Harmonization Task Force and the consultation among EPA, DOE and OMB on EPA's draft rulemaking for cleanup criteria for DOE facilities. Therefore, we request that the discussions during the April 21 meeting be focused on: (1) clarification of NRC and EPA staff views on the proposed rule and (2) presentation of data or views on matters that have not previously been discussed.
