Although I have no problem with the substance of the proposed rule that the staff has forwarded for Commission approval, I believe that this rulemaking is neither necessary nor consistent with Executive Order 12866.
I continue to believe that, whenever possible (i.e. when our objective can be met in another way) we snould avoid rulemaking so that we can apply our resources most effectively.
