EXEMPTION FROM SUBMITTAL DATE F0F UPDATED FINAL SAFETY ANALYSIS REPORT (FSAR)

Re: Millstone Nuclear Pcwor Station, Unit No. 1 On April 11, 1985, the NRC issued an exemption from certain requirements of Section 50.71(e) of 10 CFR 50 in response to a renuest from Northeast Nuclear Energy Company (NNECO) dated February 4, 1985. That exemption permitted a six-month extension, from date of issuence, for the submission of an updated FSAP for Millstone Unit 1.

Also, the staff stated that any additional exemptions from compliance with 10 CFR 50.71 would be granted by the Director of Licensing, ONPP, only upon the review and approval of a program plan containing schedules and milestones for the submittal of the updated FSAR.

On July 31, 1985, the NPC issuad the results of its screening review for the topics to be included ir the integrated Safety Assessment Program (ISAP) scope of review for Millstone Unit 1.

In that scope of review, the staff included the FSAR update, designated as ISAP Topic 1.15.

By letter dated September 13, 19ff, NNFC0 requested an additional exemption from the schedular requirements of 10 CFR 50.71(e) for Millstone Unit 1.

In that letter, in addition to the fact that this facility is participating in ISAP, it was pointed out that a number of other pro,iects at Millstone Unit 1, as well as at Millstore Units 2 and 3, and Haddam Neck vill impact the quality of the FSAR update. That is, there are other ongoing projects that will not only affect tte resource requirements for performing the FSAP update tut the results of the projects should be an integral part of the update.

Therefort, Pt.'FC0 reouested that the submission date be extended to March 31, 1907. However, the staff, by lettcr dated October 2,1985 infort >d NFECO thct inforcation submitted in its September 13, 1985 exemption request was ret responsive to the terms identified in the exemption granted on April 11,19PS.

That is, the staff determined that a plan containing the required milestones and schedule, demonstrating a cred faith effort to reasonably achieve compliance, had not been provided.

November 22, 1985 2-By letter dated October 11,1985, NNEC0 resubmitted its request for a schedular exemption to the requirements of 10 CFR 50.71(e).

In that letter, NNEC0 provided milestones and schedules for the submittal of the component parts of an updated FSAR and for completion of the entire FSAR update.

In sumary, NNEC0 proposes to provide:

(1) stand alone document descriptions such as emergency planning, by April 30, 1986; (2) updated system descriptions and piping and instrumentation diagrams by July 1,1986; and (3) the major part of the FSAR update by December 31, 1986 with the balance submitted by March 31, 1987. Accordingly, NNEC0 requested formal relief from the schedular requirements of 10 CFR 50.71(e) until March 31, 1987 for Millstone Unit 1.

This date will allow time for the additional editing and changes necessary to ensure overall document consistency when the individual components are incorporated into the j

updated FSAR.

The staff has evaluated the October 11, 1985 exet, request.

The results of the staff's evaluation, as described in the enclosed Exemption, find that your request for an addition exemption meets the requirements identified in the original exemption issued on April 11, 1985. An exemption until March 31, 1987 is being granted for the submittal of an updated FSAR provided that milestones described above are met.

An Environmental Assessment and Finding of No Significant Impact for this action was published in the Federal Register onNov. 22,1985 ( 50FR 48284).

This exemption is being forwarded to the Office of the Federal Register for publication.
