0.-der Imposing a Civil Monetary Penalty This refers to your letter dated November 27, 1985 in response to the Notice of Violation and Proposed Imposition of Civil Penalty sent to you with our letter dated October 29, 1985. Our letter and Notice described two violations associated with events reported to the NRC by members of your staff.
In your response, you admit the occurrence of the violations but request that the severity level of the aggregate violations be reduced from Severity Level II to Severity Level III. After careful consideration of your response, we have concluded, for the reasons given in tne enclosed Order and Appendix, that a sufficient basis for reduction of the preposed severity level was not pro-vided in your response. Accordingly, we liereby serve the enclosed Order on Maine Yankee imposing a civil penalty in tha amount of Eighty Thousand Dollars.
We will review the effectiveness of your correct.ive actions already taken, and those proposed, during a subsequent inspection.
In accordance with Section 2.790 of the NRC's " Rules of Practice". Part 2, Title 10. Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
The response directed by the accompanying Order is not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
