SUBJECT:

STAFF REQUIREMENTS--SECY-85 NRC SUNSHINE ACT REGULATIONS The Commission has voted 5-0 to approve for publication for a 30 day public comment period, the proposed rule change to Part 9, Subpart C - Government in the Sunshine Act Regulations. The essence of the rule change is to conform the definition of

" meeting" therein to the decision of the Supreme Court in Federal Communications Commission v. ITT World Communications -

U.S. 104 S.Ct. 1936 (1984).

In this regard, attached is a Commission approved copy of the proposed rule denoting Commission changes to the text.

The Commission has decided (with Commissioner Asselstine dis-agreeing) to make the application of the rule change to appro-priate Commission meetings and/or conferences effective during the 30 day public comment period. Your office is to draft the appropriate language for inclusion in the " Statement of Consid-erations" to achieve the effective operation of the rule change during the comment period.

You should make the indicated revisions and return the Federal Register Notice for signature and publication.
