Pursuant to Subtitle E of the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 801, the Nuclear Regulatory Commission (NRC) is submitting Revision 2 of Regulatory Guide 5.15, " Tamper-Indicating Seals for the Protection and Control of Special Nuclear Material." j This Revision 1 of Regulatory Guide 5.15 provides guidance on features of security seal systems and types of seals that are acceptable to the NRC staff I for tamper-safing containers of special nuclear material.

We have determined that this regulatory guide is not a " major rule" as defined j in 5 U.S.C. 804(2). We have confirmed this determination with the Office of Management and Budget.  !

Enclosed is a copy of Revision 1 of Regulatory Guide 5.15, which will be distributed to affected licensees and other interested parties.

1. PROPOSED ACTION i

1.1 Descriotion and Need j This guide provides guidance on features of security seal systems and it describes types of seals that are acceptable to the NRC staff for tamper-safing of special nuclear material (SNM). This guide was originally issued in January 1974. A revision to this guide is needed to bring it up to date with respect to current regulations and technology.

1.2 Value/Imoact l

1.2.1 NRC Operations The regulatory position will be brought up to date.

1.2.2 Other Government Aaencies Not applicable. (.

l.2.3 Industry Existing systems or commitments in NRC-approved fundamental nuclear material control plans need not be modified to correspond with this revision.

Using the tamper-indicating systems discussed in this guide would have no adverse impact on the industry.

1.2.4 Public No adverse impact on the public can be foreseen.

1.3 Decision on the Procosed Action Revised guidance is needed to reflect the improvements in tamper-indicating technologies for the protection of SNM.

- i Authority for the proposed action is derived from the Atomic Energy Act of l

1954, as amended, and the Energy Reorganization Act of 1974, as amended, and implemented through the Commission's regulations.

O Revising this regulatory guide is not a major action that may significantly affect the quality of the human environment and does not require I an environmental impact statement.

5. RELATIONSHIP TO OTHER EXISTING PROPOSED REGULATIONS OR POLICIES Revising this regulatory guide is not directly related to any proposed l regulations or policy. The proposed guidance is consistent with existing l regulations.

6. SUMARY AND CONCLUSIONS The proposed guide should be issued for public comment.
