APPENDIX A NOTICE OF VIOLATION Nebraska Public Power District Docket:

50-298/85-19 Cooper Nuclear Station License:

DPR-46 During an NRC inspection conducted during the period June 10-14, 1985, violations of NRC requirements were identified.

The violations involved the failure to have Cooper Nuclear Station (CNS) procedures to prevent or control the use of voided, deleted, or superseded safety-related and as-built drawings and the failure to use an approved lock.

In accordance with the " General Statement of Policy and Procedure fnr NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violations are listed below:

Station Procedures to Prevent or Control the Use of Voided, Deleted, or Superseded Safety-Related Drawings and As-Built Drawings 10 CFR Part 50, Appendix B, Criterion V requires that activities affecting quality be prescribed by documented instructions or procedures which shall include appropriate quantitative or qualitative acceptance criteria.

Contrary to the above, no CNS procedure existed to prevent or control the use at CNS of safety-related drawings specified by the NPPD document control system as being voided, superseded, or deleted, or as being construction drawings which had not been certified as as-built drawings.

This is a Severity Level IV violation (Supplement I.D) (50-298/8519-01).

Approved Lock for Safeguards Drawings Cabinet 10 CFR 73.21, (d)(2) states:

"While unattended, Safeguards Information shall be stored in a locked security storage container.

Knowledge of lock combinations protecting Safeguards Information shall be limited to a minimum number of personnel for operating purposes who have a 'need to know' and are otherwise authorized access to Safeguards Information in accordance with the provisions of this section."

The Atomic Energy Act, Section 147, states that guidance on protection of safeguards information shall be provided by the NRC.

NRC guidance for padlocks for safeguards information is contained in NUREG-0794, " Protection of Unclassified Safeguards Information," Section 4.1 Storage, which further requires padlocks to be a "GSA approved combination padlock."

Contrary to the above a CNS storage cabinet for safeguards drawings was secured with a key padlock.

This is a Severity Level V violation (Supplement III.E) (50-298/8519-01).

. Pursuant to the provisions of 10 CFR 2.201, Nebraska Public Power District is hereby required to submit to this office, within 30 days of the date of the letter transmitting this *lotice, a written statement or explanation in reply, including: -(1) the reason for the violations if admitted, (2) the corrective steps which have been taken and the results achieved; (3) corrective steps which will Ibe taken to avoid further violations; and (4) the date when full compliance will-be achieved.

Where good cause is-shown, consideration will be given to extending the response time.
