Docket No.:
50-483 Mr. D. F. Schnell Vice President - Nuclear Union Electric Company Post Office Box 149 St. Louis, Missouri 63166
Dear Mr. Schnell:
Subject:
Letter from Donald F. Schnell to Harold R. Denton dated November 15, 1985,
Subject:
Application for Reload License Amendment Usin Westinghouse Optimized Fuel Assemblies (ULNRC-1207 The staff has been having difficulty in providing a Federal Register Notice regarding the referenced application. The reason for this difficulty is that the no significant hazards consideration (NSHC) analysis is deficient. What is presented is a botton line boilerplate that references the preceding dis-cussion. The preceding discussion has a lot of information, but little, if any, is in the form of assessing the change in the probability or consequences of an accident previously evaluated, in the possibility of a new accident, or a reduction in a safety margin. All that is presented is just a lot of con-clusions that the requests do not create a significant safety concern.
10 CFR 50.91(a)(1) requires that if censees requesting an amendment provide an analysis "using the standards in 50.92" (the three factor test) about the issue of N5HC. As mentioned above, on this application it is difficult to draw the conclusion of no significant hazards. A final assertion that references the entire preceding discussion as justification for passing the three factor test is not considered satisfactory. Each of the inree factors should be addressed separately for each part of the license amendment request. An assertion with-out appropriate analysis does not satisfy 10 CFR 50.91(a)(1).
It is requested that you revise the NSHC presented in VLNRC-1707 with a NSHC which satisfies 10 CFR 50.91(a)(1).
In addition, since the staff cannot currently accept ynur submitted BASH (large break LOCA) analysis, as discussed in my letter to you dated December 30, 1985, it is suggested that your revised NSHC address this as well.
Sincerely, i
/5 B. J. Youngblood, Director PWR Project Directorate #4 Division of PWR Licensing-A, NRR cc:
