.s In anster to the instructions on page 7 paragraphic C.2 CLI 85-18, I, Marvin I. Lewis, petition to intervene in the TMI Leak Rate Falsification Inquiry. My interest is both extensive and immediate.

My interest extends.back to the original-accident and TMI Resart Hearings. I was an intervenor in the TMI

Restart Hearings, and I contended that the cracked radioactive waste gas manifold should be repaired before restart.

Eventually the Hearing Board, the NRC Staff and the Licensee agreed that the vaste gas manifold should be repaired.

Subsequently, not only.the radioactive vaste gas manifold at TMI uss repaired ;but also, many other vaste gas manifolds were also repaired throughout the industry.

The repair of the waste gas manifolds added to the safety of nuclear power plants ; houever, I again petition to intervene as I have definite information that the leak rate falsification presents a danger even to me far away as philadelphia. The reason that I am in as danger is that the method used to provide the leak rate falsification is still in use and that method.contains procedures uhich can cause an accident much greater than any analyzed by the NRC Staff or Licensee. Some of these dangers relating to the uay leak rate will be measured and used at TMI. vere the subject of my Sept. 18,1985, filing before the ASL8 Docket No. 50-289, and vere partially based on obvious deficiencies in the TMI

presently I have even more uorrisome information.This information concerns the hydrogen that is bubbled new thru the make-up tank to aid in providing a false leak rate. Specifically, I wish to bring the NRC's official usight to bear on the definite information concerning the use of hydrogen to provide false leak rates.'This hydrogen which bubbled thru the make-up tank had a route' thru the let doun line and PORV to the containment. hydrogen used to falsify the leak rate could easily have added to the severity of the accident up to and including.

causing the failure of the containment' integrity.

This type of inquiry is a partial ansuer to the question posed in CLI 85-18 at page 5, "Uere unacceptable leak rate surveillance test results discarded in an attempt to hide them from the NRC?"

A complete answer tu this question requires certain elemehts; 1.

a definition of unacceptable.

Any procedure uhich endangers human lives or the health and safety of the oublic is unacceptable and illegal within the rules of theNRC and the letter and spirit of the Atomic Energy Act.

The hydrogen that was bubbled thru the makeup tank had a route to the containment and detonation of that unanalyzed amount of hydrogen endangered the containment.

The failure of the containment vill endanger lives and will place the health and safety of the public in great danger.

2. leak rate surveillance test results.

A test result does not stond alone.

Surely anyone can understand that

a test results needs units, gallons per hour, and reference to the unit on which the result is obtained, #1 or #2.

The importance of more suDtle parameters are often obscured:

Tne temperature of the water in the make up tank bears directly upon the test result.

Even if there is a lack cf testimony about hydrogen being bubbled thru a make up tank,large or unknown hydrogen useage vill suggest that hydrogen was being bubbled thru the makeup tank to falsify readings.

AAAo and most importantly the alignment of valving during tne test must be correct to provide proper readings.

proper definition of what is meant by ' leak rate test results' vill not only define what is meant by these terms ;but also, provide a determination of how dangerous these procedures uere to the health e

ard safety ofthe public.

Hiding any test result from any party must be viewed as an attempt to hide the test result from the NRC since the NRC has used and continues to use informants to provide valuable information.

Hydrogen bubbled thru the make-up tank presents a danger. I have explained that danger i n-m y filing dated 1/3/06 on the NUREG 0956, Draft Report For Comment Reassessment of the Technical Bases for Estimating Source Terms.

The danger that hydrogen used for falsifying leak rate poses to the containment integrity is explained on page 9 and 10 of my comments.

I am enclosing my connents on NUREG 0956 with this filing.

In summary, I have demonstrated that I have interest,thot my intervention can substantially aid the completeness of the record, and that the subject, danger from hydrogen,is presently an unanalyzed danger to the containment integrity.
