This is in response to your letter and enclosure, dated November 4, 1985 (your reference # LA 85-87), in which you requested a one-time exemption from the commitment contained in Section 7.1.l(a) of your Fundamental Nuclear Material Control Plan (FNMCP).
We have determinad that your request, for this particular circumstance, is both necessary and acceptable. We have further determined that the granting of your request will not adversely affect the common defense and security nor the public health and safet y, and is otherwise in the public interest. Accordingly, we are adding the.following unnumbered license condition to Amendment SG-2 of your License No. SNM-1107, effective immediately, to read as follows:
Notwithstanding the commitment contained in Section 7.1.1(a) of the 31an d:.dentified in Condition 2.1, the licensee need not satisfy the " witnessing f off-site UF sampling" requirement with respect to the 14 UF cylinders g
6 identified in the attachment of his November 4, 1985 letter (LA 85-87).
We have determined that the enclosure to your November 4, 1985 letter contains information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4) and shall be withheld from public disclosure unless subject to the provisions of 10 CFR 9.12.
