SUBJECT: NRC INSPECTION REPORT NO. 50-331/96013 AND NOTICE OF VIOLATION

Dear Mr. Liu:

On February 3,1997, the NRC completed a routine safety inspection at your Duane Arnold

Energy Center (DAEC) facility. The enclosed report presents the results of that inspection.

During the 6-week period covered by this inspection, your conduct of activities at the

Duane Arnold Energy Center facility was characterized by a safety conscious approach.

We are concerned, however, about two violations of NRC requirements that were

identified. In the first case, NRC inspectors identified that main steam line radiation

monitors were not set according to Technical Specifications. In the second case, NRC

inspectors identified two examples where uncontrolled documents were used during ,

surveillances. l

The violations are cited in the enclosed Notice of Violation (Notice), and the circumstances

surrounding the violations are described in detail in the enclosed report. Please note that l

you are required to respond to this letter and should follow the instructions specified in the

enclosed Notice when preparing your response. The NRC will use your response, in part, i

to determine whether further enforcement action is necessary to ensure compliance with  ;

regulatory requirements.

Continuing a theme from the prior inspection report, materiel condition issues continue to

be a challenge. Although we observed prompt and conservative decisions to make

necessary repairs, the materiel condition issues discussed in this report did result in the

need for two plant downpowers and one plant shutdown.

During this inspection period, we observed several examples of inattention to detail as

documented in the enclosed report. Although the examples had a low safety significance,

we were concerned because they were noted across multiple departments,

in accordance with 10 CFR Part 2.790 of the NRC's " Rules of Practice," a copy of this

letter and its enclosures will be placed in the NRC Public Document Room (PDR).
