SUBJECT:

REGULATORY HISTORY PROCEDURES In a memorandum dated April 5,1985, the Executive Director for Operations established procedures for ensuring that a complete regulatory history is compiled for each rulemaking action undertaken by an office under his purview.

These procedures are applicable to any proposed or final rule submitted for publication in the Federal Register after April 5, 1985.

Briefly, these procedures require that --

. Documents of central relevance to a rulemaking be identified, maintained, and accessible;

  • An index of the documents comprising the regulatory history (beRPB) developed and submitted to the Rules and Procedures Branch within sixty days after the rulemaking is completed.

The final rule incorpcrating by reference into 10 CFR Part 50 the latest addenda to the American Society of Mechanical Engineers Boiler and Pressure Vessel Code for Sections III and XI of Division 1 was published in the Federal Register, as we discussed, September 26, 1985 (50 FR 38970). Since you sent the regulatory history index for the proposed rule to RPB, we have developed some guidance for preparing these histories that may be useful to you (Enclosure).

You should forward the completed index for the final rule to RPB by November 21, 1985.

In order to assist you in the preparation of the list of the documents centrally relevant to this final rule, place the designator AA83-2 in the upper right hand corner of each such document that you send to the Document Control System (DCS). When you are ready to compile your history, DCS staff will use the designator to retrieve a list of all these documents from their data base.

GUIDANCE FOR PREPARING A REGULATORY HISTORY Q:

What documents are centrally relevant to a rule's history?

A:

See attached William J. Dirck's April 5,1985, memorandum, " Regulatory History Procedures."

Q:

Who decides whether a document that is centrally relevant to a rule's history should be entered in the Document Control System (DCS)?

A:

You do--here's the guidance for making the decision.

Basically, do not list a document in your index (which is placed in the PDR) that you would not want to release under a Freedom of Information Act request?

Two categories of documents may be entered in the DCS:

Those for public use, which are placed in the Public 1.

DocumentRoom(PDR);and 2.

Those for internal use only, which are placed in Central Files (accession numbers for documents placed in central files are not available to the public).

The most " sensitive" information entered in the DCS is " Proprietary" for which only a non-proprietary version may be released.

No " Classified" or " Safeguards" document is entered in the DCS.

Q:

Must each historical document have a designator?

A:

Yes. The Rules and Procedures Branch, DRR, will provide it to you after your proposed or final rule it published in the Federal Register. The designator comprises an alphanumeric number, which is assigned by the Office of Management and Budget to each rulemaking entry in their bi-annual agenda, plus "-1" for a proposed rule and "-2" for a final rule, e.g., AB93-1.

It should be placed in the upper right-hand corner of each historical document.

Q:

How do I ensure that each document is available only to appropriate users?

A:

You must do the following:

Send a transmittal slip or memorandum with your documents to the DCS stating that documents X through Y are to be placed in the PDR and documents A through B in Central Files.

Place the appropriate designator and "PDR" in the upper right-hand corner of each document to be made publicly available.

and Place only a designator in the upper right-hand corner of each document to be made internally available. Then, band them together and cover these documents with a sheet clearly marked " Central Files."

Q:

How do I find out whether a document is in the PDR?

A:

One of two ways:

Try to call the document up on an accession terminal, or Ask the PDR -- extension 43273.

How may I locate a copy of an NRC document centrally relevant to my rule that is not in the DCS or no longer in my possession, e.g., source document, interagency correspondence?

Through interoffice mail, in as complete a package as possible to facilitate the DCS task of putting the entire history in sequence on microfiche cards. Documents may be sent individually or in small groups, but no matter how many you send at one time, each document must be appropriately designated and transmitted with an instructive slip or i

memorandum.

How do I obtain a list of all documents in the DCS designated for my rule's history?

Call 28603, the DCS Hot Line (an NRC contractor). They will send you a computer printout of all documents bearing the designator for your rule that have been placed in the DCS.
