! 1. The material submitted has been held in confidence by NUS and its l employees and is not available through public sources. ,

2. N!$PSC's Radweste Solidification and Transfix systems are major components of its waste processing business. These systems for 1rocessing radioactive liquid wastes are unique to NUSPSC and represent a susstantial commitment of personnel and financial resources for research, design and procedural controls.

Mr. Murray R. Edelman NOV 181985 NUSPSC feels its system is superior to that provided by competitors and this superiority is the basis on which system details are withheld from public dis-closure. NUSPSC has expended a great deal of time, money and capital equipment and is engaged in a capital building project to make these systems available.

Release through public channels of the procedures will substantially harm the competitive position of NUSPSC.

We have reviewed your application and the material based on the requirements and criteria of 10 CFR 2.790 and on the basis of NUSPCS and your statements, have detennined that the submitted information sought to be withheld contains trade secrets or proprietary corrercial information.

We have determined that the above stated documents marked as proprietary, should be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the 4tomic Energy Act of 1954, as amended.

We, therefore, approve your request for withholding pursuant to 10 CFR 2.790 and are withholding the above stated documents from public inspection as proprietary.

l Withholding from public 1.ispection shall not affect the right, if any, of per-sons properly and directly concerned to inspect the documents. If the need I

arises, we may send copies of this infomation to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreceents for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the l future, such as if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any pubite disclosure.
