MEMORANDUM AND ORDER By letter dated September 30, 1985, the Connecticut Yankee Atomic Power Company ("CYAPC0") requests that the Commission grant an extension from the November 30, 1985 deadline for environmental qualification of electrical equipment at the Haddam Neck Nuclear Plant. The request covers two types of' equipment for which an extension is sought until the January 1986 plant outage. The Commission has reviewed in detail the licensee's submittal and the staff's analysis and recommendation as set forth in SECY-85-337. Based on this review the Commission finds that the licensee has demonstrated the exceptional nature of its case such that an extension will be granted.

The Comission most recently addressed the environmental qualifica-tion issue in Generic Letter 85-15, issued August 6, 1985. In that letter the Commission stated that extensions from the November 30

2 deadline established in 10 CFR 50.49(g) would be granted "only in rare circumstances." The Comission further stated that extension requests "must clearly identify the exceptional nature of the case, e.g., why, through events entirely beyond its control, the licensee will not be in compliance on November 30; the date when compliance will be achieved; and a justification for continued operation until compliance will be achieved." The Commission also set forth an enforcement policy regarding failure to meet the deadline.

CYAPC0's efforts relating to environmental qualification in general and to the particular pieces of equipment still at issue denote a good faith attempt to achieve compliance with the November 30 deadline. The environmentally qualified replacements for the equipment in question, fourteen valve motor operators and twenty reactor coolant system loop resistence temperature detectors, had been ordered in anticipation of installing them during a scheduled November 1985 outage. In fact, the equipment, which is most safely and efficiently installed while the plant is not operating, currently is available at the site awaiting installation. Unfortunately, a reactor cavity seal failure occurred during the previous refueling outage in the sumer of 1984, which required that the licensee reschedule the November 1985 outage to January 1986. As a result of this unforseen circumstance, the licensee's original intention to qualify the equipment within the deadline has been frustrated. Under these circumstances, the Comission finds that an extension is warranted.

'9 3 continued operation and finds they support safe operation until the planned January 1986 refueling outage. The deadline for equipment qualification is hereby extended,until that outage, but no later than January 4, 1986.
