This will acknowledge receipt of your letter dated October 25, 1985.and your check for $100,000 in payment of civil penalties proposed by NRC in a letter dated September 25, 1985. We note that your September 25, 1985 letter describes the fine imposed for the failure to report a security event as severe. . As discussed in our September 25, 1985 letter, although you initially considered reporting the event, no report was made to the NRC. Further, when the original incident was identified by an NRC Resident Inspector, two more examples of degradations in barriers were discovered as a result of the safeguards inspection. ,

As part of our decision making process in establishing the severity level of

.the reporting violation and its associated civil penalty, we considered such things as the significance of 'the underlying violation and your awareness that the event was reportable. We acknowledge your explanation that the failure to l report the event resulted from an erroneous judgement on the part of management

. personnel. However, the NRC expects licensees to provide complete, accurate, N and timely information regarding reportable security events. For the above

, reasons we believe the severity level and associated civil penalty for the reporting violation was appropriate.
