A Request for modification to the Confirmatory Action Letter Dated November 20,1996, Docket No. 70-1201, License No. SNM-1168, CAL No. H-96-001

Dear Dr. Papariello,

Framatome Cogema Fuels reviewed the Confirmatory Action Letter dated November 20,1996.

We expect our Root Cause Analysis and Corrective Action to be transmitted to the NRC by November 27 as agreed. With respect to the last agreement in the Confirmatory Action Letter concerning receipt of additioinal VVER fuel for downloading, Framatome Cogema Fuels requests approval to receive and verify shipping containers currently in Customs at Norfolk, Virginia. FCF agrees not to commence with the removal of the assemblies from the transport packages until all corrective actions agreed to between the NRC and FCF have been implemented and verified. We would receive the sea-vans, unload the transport packages from the sea-vans, verify all serial numbers vs. shipping documents, verify that tamper seals are intact and store them in the plant protected area.

Framatome Cogema Fuels believes this request is reasonable and necessary because the U.S.

Customs release date is currently uncertain and that once released, the material should be promptly transported to a secure facility and stored there until the corrective actions pursuant to the recent shipping problem are implemented. Framatome Cogema Fuels discussed this option with Region Il and your staff via telephone conference at 8:00 a.m. on November 22 and we believe general agreement exists. Your consideration of this request is appreciated.
