! NOTICE OF VIOLATION 4  ;

l Union Electric Company Docket No.: 50-483  :

i Callaway Plant License No.: NPF-30 j During an NRC inspection conducted on November _4-8,1996, two violations of NRC l

! requirements were identified. In accordance with the " General Statement of Policy and  !

j Procedure for NRC Enforcement Actions," NUREG-1600,the violations are listed below  ;

4 l l A. Technical Specification 6.12.1 states, in part, that each high radiation area, as l defined in 10 CFR Part 20, shall be barricaded and conspicuously posted as a high  !

f radiation area. A high radiation area is defined in 10 CFR 20.1003 as an area, I

accessible to individuals, in which radiation levels could result in an individual

! receiving a dose equivalent in excess of O.1 rem in one hour at 30 centimeters from the radiation source or from any surface that the radiation penetrates.  !

! 10 CFR 20.1902 requires the posting of each high radiation area with a j conspicuous sign bearing the radiation symbol and the words " Caution, High  ;

Radiation Area."

l l Contrary to the above, the licensee did not barricade and conspicuously post the j j entrance to "D" steam generator bay on November 4,1996.  !

This is a Severity Level IV violation (Supplement IV )(483/9612-01). {

l B. Technical Specification 6.8.1 states that written procedures shall be established, j implemented, and maintained covering the activities recommended in Appendix A of l Regulatory Guide 1.33, Revision 2, February 1978. Regulatory Guide 1.33, l i Appendix A, Section 7e.(4) lists " contamination control."

I l Procedure HTP-ZZ-02005," Handling and Control of Radioactive Material," )

Revision 20, Section 4.2.1.1, states that health physics personnel shall survey l l items removed from the radiological controlled area to ensure the items meet t i established criteria for unconditional release.

I 49 CFR 171.2(a) states, in part, that no person may offer or accept a hazardous material for transportation in commerce unless the hazardous materialis properly A

classed, described, packaged, marked, labeled, and in condition for shipment as l required or authorized by 49 CFR Parts 171-177.

4 i Contrary to the above, on October 24,1996, health physics personnel did not j survey the trunnions that were attached to a radioactive shipping container and did i not identify beta / gamma contamination levels in excess of the established criteria of 1000 disintegrations per minute per 100 centimeters squared before allowing items j to be unconditional released from the licensee's control. Also, licensee personnel j did not classify, describe, package, mark, and label radioactive material before 4 offering it for shipment.

2-This is a Severity Level IV violation (Supplements IV and V)(483/9612-03).

Pursuant to the provisions of 10 CFR 2.201, Union Electric Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 2055G with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident inspector at the f acility that is the subject of this Notice, within 30 days of the date of ti e letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full-compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken.

Where goc , cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction. However,if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
