ROUTINE RESIDENT INSPECTION AT DAVIS-BESSE (50-346/96014);
NOTICE OF VIOLATION AND EXERCISE OF ENFORCEMENT DISCRETION

Dear Mr. Wood:
The NRC completed an inspection at your Davis-Besse site with preliminary results presented
<
to members of your staff on January 24,1997. The final results were discussed with your
staff on February 13,1997. The enclosed report presents the details of that inspection.
Overall, we noted that equipment material condition was maintained at a high level. Good

interdepartmental communications was again noted, especially during conditions reouiring
response to onsite events.

Three violations of NRC requirements were identified during the inspection.
The first violation involved three examples of failure to follow procedures during the
performance of testing activities. We note that the procedure adherence problems found
during this inspection appear similar to procedural issues identified during other recent NRC
.

inspections. We are concemed that there may be one or more common underlying cause(s)
and contributing factors that have not yet been recognized and corrected.

The second violation related to your failure to include 10 CFR 70.24 required criticality
monitors in your new fuel storage area since issuance of your operating license in 1977.
Although the NRC had previously granted Davis-Besse an exemption from this requirement as
part of your prior license to possess special nuclear material, that exemption was not
transferred to your current operating license.
The third violation involved the recent identification that original engineering design
calculations prepared to support the design and operation of the control room emergency
ventilation system were inadequate. As discussed in detailin Section E1.1 of the inspection
report, Davis-Besse personnel identified this condition, which was not likely to be discovered
as the result of routine surveillance or quality assurance activities, and took
prompt and comprehensive corrective action. In accordance with the provisions of
Section Vll.B.3 of NUREG-1600, " General Statement of Policy and Procedures for NRC
Enforcement Actions," and after consultation with the Director, Office of Enforcement, I
