Appendix NOTICE OF VIOLATION Commonwealth Edison Company Docket No. 50-373 Docket No. 50-374 As a result of the inspection conducted on August 5-13, 1985, and in accordance with the General Policy and Procedures for NRC Enforcement Actions, (10 CFR Part 2, Appendix C), the following violations were identified:

1. 10 CFR 20.207(a) and (b) require that licensed material stored in an unrestricted area be secured from unauthorized removal from the place of storage and that radioactive material not in storage be under constant surveillance and immediate control of the licensee.

Contrary to the above, radioactive material found in an unrestricted area 1 onsite dump was not secured from unauthorized removal, nor was it under constant surveillance of the licensee.

This is a Severity Level IV violation (Supplement IV).

2. 10 CFR 20.201(b) requires that surveys be conducted as may be necessary for the licensee to comply with 10 CFR 20.103 and as are reasonable to evaluate the radiation hazards.

4 Contrary to the above, no air samples were taken in the offgas filter building on August 7, 1985, to ensure persons would not be exposed to 3 airborne concentrations in excess of 10 CFR 20.103 limits.

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to 1 this office within thirty days of the date of this Notice a written statement i or explanation in reply, including for each item of noncompliance: (1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Consideration may be given to extending your response time for good cause shown.
