COOPER NUCLEAR STATION - THIRD TEN-YEAR INTERVAL PUMP AND VALVE INSERVICE TESTING PROGRAM RELIEF REQUESTS (TAC NO. M94530)

Dear Mr. Horn:

4 By letter dated November 21, 1995, the Nebraska Public Power District (NPPD) submitted relief requests RP-01 through RP-04, and RV-01 through RV-14 for 1 Cooper Nuclear Station (CNS), third ten-year interval program for inservice testing (IST) of pumps and valves. The Nuclear Regulatory Commission (NRC)  ;

i staff evaluated these relief requests and the staff's safety evaluation (SE) is enclosed.

The Code of Federal Regulations,10 CFR 50.55a, requires that inservice testing of certain Code Class 1, 2, and 3 pumps and valves be performed in accordance with Section XI of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code and applicable addenda, except where relief has been requested and granted or proposed alternatives have been

, authorized by the Commission pursuant to 10 CFR 50.55a(f)(6)(1), (a)(3)(i), or (a)(3)(ii). The NRC staff's findings with respect to the requests for relief l and approval of alternatives proposed as part of the CNS IST program are 2

contained in the enclosed SE. The staff's specific findings are summarized below.

The proposed alternatives in relief requests RP-1, RP-2, RP-3, and RP-4 are authorized pursuant to 10 CFR 50.55a, paragraph (a)(3)(ii). For relief

requests RV-8, RV-9, and RV-13, the proposed alternatives are authorized 1

pursuant to 10 CFR 50.55a, paragraph (a)(3)(i), for 1 year from the date of this letter to allow you sufficient time to develop a method to adequately j monitor for valve degradation. Relief requests RV-2, RV-3, RV-4, and RV-5 are

' approved pursuant to NRC Generic Letter (GL) 89-04; however, implementation of the alternative in accordance with GL 89-04, Position 7 is subject to NRC inspection.

Relief requests RV-6, RV-7, RV-11, RV-12, and RV-14 are denied, as described in the enclosed SE. You must take actions within 120 days from the date of this letter to comply with the Code requirements or submit revised relief 1

requests for staff review and approval.

, Relief request RV-1, which proposes to base the scope of the IST program on

" safe" shutdown rather than cold shutdown, is not required; however, the IST 4

program document submitted to the NRC must state the special condition for the 4

l plant in an introductory section (as discussed in Section 2.2 of NUREG-1482).

Relief request RV-10 is considered acceptable under the provisions in Operations and Maintenance (0N) Standards, Part 10 (OM-10) and, therefore, relief is not required.

! The staff has not performed a detailed review of your letter of October 25, 1996, which transmitted Revision 1 to the third ten-year interval IST program for CNS. Based on our initial review, it appears that the only changes to the relief requests previously submitted in your November 21, 1995, letter are a minor revision to RV-14, which would not affect the staff's denial of that relief request, and the. addition of a new pump relief request, RP-5, which the staff will review separately.

This letter grants, in part, the relief requested. In cases where the staff has granted interim relief, or has denied the requested relief, you are expected to take appropriate action within the specified time periods to meet the applicable Code requirements.

For those relief requests found acceptable by the'NRC staff, as discussed above, we have determined that.the granting of relief is authorized by law, will not endanger life or property or the common defense and security, and is otherwise in the public interest. In making this determination, we have given due consideration to the burden that could result if the applicable ASME Code requirements were imposed on your facility. This letter grants, in part, the relief requested. In cases where the staff has granted interim relief,.or has denied the requested relief, you are expected to take appropriate action within the specified time periods to meet the applicable Code requirements.
