SUBJECT:

ALLEGED ALTERATION OF COPY OF AAMODT MOTIONS Attached for your infonnation is a memorandum report of the results of our inquiry into the alleged alteration of a copy of the AAMODT Motions b recently retired Dr. William A. MILLS, Chief, Health Effects Branch (yHEB),

Division of Radiation Programs and Earth Sciences (DRPES), Office of Nuclear Regulatory Research (RES), U.S. Nuclear Regulatory Commission (NRC).

This inquiry is based on an allegation made by Marjorie and Norman AAMODT, R.D. 5, Box 428, Coatesville, Pennsylvania that a copy of their Motions concerning Investigation of Licensee's Reports of Radioactive Releases During the Initial Days of the TMI-2 Accident and Postponement of Restart Decision Pending Resolution of this Investigation were deliberately altered by Dr. MILLS. The AAM0DTS' accused Dr. MILLS of removing pages and affidavits from their Motions when Dr. MILLS sent Dr. Glyn CALDWELL, Assistant Director for Epidemiology, Chronic Diseases Division, Center for Environmental Health, Atlanta, Georgia a copy of the Motions for review and comment.

~ The Office of Inspector and Auditor contacted Ms. Desiree MILTON, Branch Chief Secretary, HEB, DRPES, RES, who stated that the missing pages and Affidavits of the AAMODT Motions sent to Dr. CALDWELL were inadvertently missed when she xeroxed a copy of the Motions and mailed them for Dr. MILLS. MILTON explained that she did not realize that some of the pages of the Motions had to be re-produced on both sides and, therefore, only one side was copied. A review of CONTACT: Keith G. the Motions disclosed that the missing pages were the pages on the reverse side of the document. MILTON related that neither Dr. MILLS nor she had intentionally tried to deceive Dr. CALDWELL in his review.

CONCLUSION There is no evidence which indicates any attempt or deliberate act on the part of Dr. MILLS, MILTON, or the NRC to deceive Dr. CALDWELL in his review of the AAMODT Motions.

On February 20, 1985, the U.S. Department of Justice (D0J) notified the AAM0DTS that there was no evidence that Dr. MILLS deliberately withheld portions of the AAMODT Motions from the information provided to D0J by the AAM0DTS.

Based on the foregoing, this inquiry is closed.

Investigative Plan Date: April 25, 1985

Title:

NRR Staff Member Dr. William A. MILLS, Altered Copy of AAMODT's Motion by Removing Pages and Affidavits.

Allegation: Dr. William A. MILLS, Chief, Health Effects Branch, Division of Radiation Programs and Earth Sciences, Office of Nuclear Regulatory Research, sent a letter to Dr. Gly COLDWELL, 5124 Golfbrook Drive, Stone Mountain, Georgia. The letter indicated that the AAMODT's Motions were enclosed and that a review of the AAMODT's Motions were requested.

The copy of the AAMODT's Motion, when received by Dr. CALDWELL, was missing pages 2, 4, 6, 9, 11, Figure 1, Affidavits 2, 4, 7, 9 and parts of Affidavit I and Attachment 2. Dr. CALDWELL states that these deletions were noted in comparison with a copy of the same documents supplied to Dr. CALDWELL by Dr. George TOKUHATA.

The AAM0DT's allegations that the alteration of the documents were a deliber-ate act on the part of NRC to deceive Dr. CALDWELL.

Plan of Action

1. Interview Dr. MILLS.
2. Obtain copy of AAMODT's Motion.
3. Interview other appropriate personnel as they develop.
