HYDRO RESOURCES, INC.

Dear Dr. Klonowski:

You raised several concerns at a public ac:: ting held by the Nuclear Regulatory Commission on February 22, 1995, with regard to an application by Hydro Resources, Inc. (HRI). One of those concerns was that there was a lack of informed con. cent by landowners asked to sign leases. That issue is outside  ;

the jurisdiction of NRC. We are therefore referring that matter to the Bureau 1 of Indian Affairs (BIA) for response. We will provide you with a copy of BIA's response when we receive it.

The other concerns you raised were in the nature of comments on the Environmental Impact Statement (EIS), which is still under development by NRC.

Those concerns will be treated as comments on the draft EIS and will be addressed in the EIS development process.

It is the policy of the Nuclear Regulatory Commission (NRC) normally not to disclose the identity of a person providing information to NRC (an " alleger")

to any organization, individual, or the public. However, there are certain limitations or exceptions, the occurrence of which might result in the disclosure of an alleger's identity.

Those limitations or exceptions are as follows: (1) the alleger has no objection to his or her identity being disclosed; (2) disclosure is necessary ,

in the event of an emergency (danger to public health or safety); (3) '

disclosure is necessary to inform Congress or State or Federal agencies in 1 furtherance of NRC responsibilities under law or public trust; or (4) the  !

alleger has taken actions that are inconsistent with and override the purpose of protecting the alleger's identity, e.g., disclosing his or her identity and the allegation to the media.
