REQUEST FOR ADDITIONAL INFORMATION REQUEST FOR TEMPORARY EXEMPTION FROM 10 CFR PART 73, APPENDIX B REQUIREMENTS DURING COVID-10 PANDEMIC HOLTEC DECOMMISSIONING INTERNATIONAL, LLC OYSTER CREEK ENVIRONAMENTAL PROTECTION, LLC OYSTER CREEK NUCLEAR GENERATING STATION DOCKET NO. 50-219, 72-15 By letter dated May 7, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML20128J904), Holtec Decommissioning International, LLC (HDI, the licensee) requested temporary exemption from certain requalification requirements for security personnel at Oyster Creek Nuclear Generating Station (OCNGS).

The U.S. Nuclear Regulatory Commission (NRC) staff is reviewing the application and has determined that the additional information below is required to complete the review.

Request for Additional Information (RAI 1)

Pursuant to Section 73.5, Specific exemptions, of Title 10 of the Code of Federal Regulations (10 CFR), the Commission may, upon application by any interested person or upon its own initiative, grant exemptions from the requirements of 10 CFR Part 73 when the exemptions are authorized by law, will not endanger life or property or the common defense and security, and are otherwise in the public interest.

Pursuant to 10 CFR 73.5, the licensee requested temporary exemptions from certain periodic requalification requirements for security personnel in Section VI, Nuclear Power Reactor Training and Qualification Plan for Personnel Performing Security Program Duties, of 10 CFR 73, Appendix B. The licensee also stated it will require an exemption to the security and training requirements in Appendix B to Part 73 and associated items in the OCNGS Security Training and Qualification Plan. However, the OCNGS training and qualification plan for security personnel is a part of a license condition.

Confirm that HDI is only requesting an exemption from the requirements in 10 CFR Part 73.
