VICINITY PROPERTY COMPLETION REPORT FOR THE RIFLE, COLORADO, VICINITY PROPERTY NUMBER RF-430

Dear Mr. Sena:

The U.S. Nuclear Regulatory Commission staff has completed its review of the Vicinity Property Completion Report (CR) and the Vicinity Property Certification Summary and Decision for vicinity property RF-430 (East Highway 6 & 24) in Rifle, Colorado, submitted by letter dated July 29, 1996.

NRC concurrence on this CR is required because the U.S. Department of Energy (D0E) applied supplemental standards during remediation.

Supplemental standards were applied to leave tailings contamination (approximately 832 cubic yards over 1198 square feet) on the southwest corner of the property due to the steepness of the slope of the property in that area.

Based on 31 boreholes, the contamination extends up to 60 inches deep.

The Ra-226 values ranged from 2 to 198 pCi/g. 00E based the application on criteria a and c of 40 CFR 192.21 because excavation on the steep slope would present hazardous conditions for workers and the estimated remedial cost would be high considering the limited potential use of the site.

Thus DOE concluded that the resulting health benefit did not warrant further remediation of this portion of the property.

For the remediated portion of w croperty, none of the cleanup verification soil samples exceed the U.S. Environmental Protection Agency (EPA) standards for Ra-226 in sail, indicating that contamination has been appropriately reduced. There are no structures on this property.

Based on the information provided by DOE, NRC staff concludes that the

\\ j remedial action complies with the approved remedial plan and concurs that remediation of the vicinity property, which includes the application of hy supplemental standards, was completed in accordance with the EPA standards.

DOE should be aware that the drawing RF-430-050 indicates that the supplemental standards area covers "1198 sy", but CR Appendix B (page 55) 000103
