Dear Mr. Corrigan:

This is in response to your letter dated May 24, 1985, in which you requested, pursuant.to the Freedom of Information Act (FOIA), all records relating to NRC requests for non-military or military personnel, including the Green Beret Forces, to penetrate and or evaluate the physical protection plans of nuclear power facilities within the United States, particularly Units 2 and 3 of the Indian Point nuclear power plant in Buchanan, New York.

The staff has informed me that the NRC does not request Green Beret, military or non-military personnel to penetrate or evaluate the physical protection plans of nuclear power facilities. The NRC does, however, have an interagency agreement with the U.S. Army 1st Special Operation's Comand to provide assistance in evaluating implemented safeguards systems at selected nuclear facilities, which is conducted as part of NRC's Regulatory Effectiveness Review (RER) program. The staff identified the records listed on the enclosed appendix as being related to your request. Documents one through seven are being placed at the NRC's Public Document Room (PDDi, 1717 H Street, NW, Washington, DC 20555 in file folder F01A-85-401. Document eight has previously been placed at the PDR. Access to this document may be acquired by referencing accession number 8504160234 when contacting the PDR. In the event you decide these records are of interest to you, I have enclosed a copy of procedures for obtaining records from the PDR.
