Inspection Nos. 50-277/85-39; 50-278/85-40

A special inspection was conducted on October 18, 1985, by a representative of

the State of South Carolina, Department of Health and Environmental Control of

a shipment of radioactive waste from the Peach Bottom Atomic Power Station.

The shipment was inspected upon its arrival at the Chem-Nuclear. Systems, Inc.,

burial site at Barnwell, South Carolina.

Areas examined during this inspection are described in a report by the repre-

sentative of the South Carolina Department of Health and Environmental Control,

which is attached to the NRC. Region I Inspection Report enclosed with this

letter. The inspection consisted of a review of shipping papers, placarding,

marking and labeling, radiation measurements,. selective contamination surveys,

and examination of the packages and the tractor-trailer.

Based on the results of the inspection, it appears that one of your activities

may not have been conducted in full compliance with NRC requirements, as described

in the enclosed inspection reports. Specifically, procedures for cask loading

and closing-were not adequately implemented.

As a result of this finding, the State of South Carolina assessed a civil penalty

of $1,000.00 on October 21, 1985.

In addition, your South Carolina Waste

Transport Permit was suspended until such time as you demonstrate to the State

of South Carolina that adequate measures have been implemented to ensure com-

pliance with all applicable provisions of federal and state law.

We are concerned about the number of violations of transportation requirements

recently identified involving shipment of radioactive waste from the Peach

Bottom Atomic Power Station.

Specifically, a previous violation was brought to

your attention by the State of South Carolina in a letter dated April 23, 1985.

Further, several other violations were brought to your attention in Notices of

Violation accompanying our letters of July 29, 1985, and September 25, 1985.

Accordingly, we have scheduled an enforcement conference with you in the Region

I office on November 14, 1985, at 9:30 a.m., to discuss the previous violations,

the recent findings, associated causes and your corrective actions.

Enforcement

action relative to the.recent findings will be the subject of separate corres-

pondence at a later date.
