l This acknowledges receipt of your letter dated February 15, 1985 in response to the Notice of Violation and Proposed Imposition of Civil Penalty sent to you with our letter dated December 12, 1984. The Notice of Violation sets out

  • a violation identified during a special NRC safety inspection conducted at your facility during the period October 25 - November 4,1984. To emMasize the importance the NRC places on licensed operators remaining in their assigned positions at the controls at all times during operation of the j

facility, a civil penalty of $50,000 was proposed.

I We have carefully considered your response in which you admitted the facts j

as set forth in the Notice of Violation and Proposed Imposition of Civil i

Penalty but denied that a violation of NRC requirements occurred. We have also given careful consideration to your request for mitigation of the proposed civil penalty. For the reasons given in the Appendix attached to the enclosed Order Imposing Civil Monetary Penalty, we have concluded that the violation did occur and that mitigation of the penalty is not i

warranted in this case. Accordingly, we hereby serve on Comonwealth l

Edison Company tM enclosed Order Imposing a Civil Monetary Penalty in theamountofFit;yThousandDollars($50,000). We will review the effectiveness of your corrective actions during a subsequent inspection.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2 Title 10, Code of Federal Regulations, a copy of this letter and the enclosure will be placed in the NRC's Public Document Room.
