Dear Mr. Speaker:
Pursuant to Subtitle E of the Small Business Regulatory Enforcement Fairness Act of 1996, 5 U.S.C. 801, the Nuclear Regulatory Commission (NRC) is submitting a final rule that will amend 10 CFR Part 51, " Environmental Protection regulations for Domestic Licensing and Related Regulatory Functions." This final rule makes minor clarifying and conforming changes and adds language inadvertently omitted from Table B-1 of the rulemaking published June 5, 1996 (61 FR 28476), which established new requirements for the environmental review of applications to renew the operating licenses of nuclear power plants. This final rule also presents an analysis of the comments received and the NRC staff responses to the comments requested in the final rule published June 5,1996. After reviewing the comments received, the NRC has determined that no substantive changes to the final rule are i warranted.
We have determined that this rule is not a " major rule" as defined in 5 U.S.C. I 804(2). We have confirmed this determination with the Office of Management l and Budget. i Enclosed is a copy of the interim final rule which is being transmitted to the Office of the Federal Register fc publication. The regulatory Flexibility Certification is included in the inal rule. The Regulatory Analysis prepared for the final rule published June 5,1996 is unchanged for this final rule.
This final rule is scheduled to become effective 30 days after publication in the Federal Reaister.
