Refueling Interval Technical Specification Change Request (ULNRC-1134)
The staff has been having difficulty in providing a Federal Register Notice regarding the referenced application. The reason for this difficulty is that the no significant hazards consideration (NSI'C) analysis is deficient. What is presented is a bottom line boilerplate with a statement that says see the above safety evaluation. The safety evaluation has a lot of information, but little, if any, is in the form of assessing the change in the probability or consequences of an accident previously evaluated, in the possibility of a new accident, or a reduction in a safety margin. All that is presented is just a lot of conclusions that the requests do not create a significant safety Concern.
10 CFR 50.91(a)(1) requires that licensees requesting an amendment provide an analysis "using the standards in 50.92" (the three factor test) about the issue of NSHC. As mentioned above, on this application it is difficult to draw the conclusion of no significant hazards. A final assertion that references the entire safety evaluation as justification for passing the three factor test is not considered satisfactory. Each of the three factors should be addressed separately for each part of the license amendnent request. An assertion with-out appropriate analysis does not satisfy 10 CFR 50.91(a)(1).
It is requested that you revise the NSHC presented in ULNRC-1134 with a NSHC which satisfies 10 CFR 50.91(a)(1).
