SUBJECT:

REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE By letter dated June 12, 1985, you submitted a report prepared by Battelle-Pacific Northwest Laboratories (BPNL) entitled " Chemical Characterization of Organic Ion-Exchange Resins Supplied by Arkansas Power and Light Company" and requested that it be withheld from public disclosure Michael A. Mann of Chem-Nuclear Systems, Inc. (CNSI) y an affidavit signed by pursuant to 10 CFR 2.790. The request is supported bdated June 10, 1985.

CNSI maintains that the BPNL's report contains proprietary infonnation derived directly from the CNSI's proprietary Mobile Cement Solidification System Operating Procedures under agreements of confidential proprietary procedures.

In addition, the affidavit references an affidavit submitted with "CNSI Mobile Cement Solidification System Topical Report CNSI-2" dated January 31, 1983.

In the earlier CNSI's affidavit, CNSI maintains that the topical report contains information of a type customarily held in confidence by them and not available from public sources and that its disclosure would harm their competitive position.

We have reviewed the application and related material based on the requirements and criteria of 10 CFR 2.790 and, on the basis of CNSI's statements, have determined that the submitted information to be withheld contains trade secrets or proprietary commercial information.

Therefore, the version (s) of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the t

need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary infonnation.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly inform the NRC.

You should also understand ~that the NRC may have cause to review this determination in the future, such as, if the scope of a Freedom of Infonnation Act request includes your information.

In all review situations, if the NRC makes a

-determination adverse to the above, you will be notified in advance of any public disclosure.
