NRC STAFF. RESPONSE TO APPLICAhTS' STATEMENT OF MATERIAL FACTS AS TO WHICH N0 GENUINE ISSUE EXISTS TO BE HEARD REGARDING CONTENTION 8 &
Appended to their Motion for Summary Disposition of Contention 11 Applicants submitted a document entitled " Statement of Material Facts as to which no Genuine Issue Exists to be Heard on Joint Intervenors Contention 11."
That document contained 87 numbered Statements of Material Fact which, pursuant to 10 C.F.R. 92.749(a), must be either controverted by the other parties or will be deemed adm.itted for purposes of any litigation which may involve Contention 8.
The Staff has addressed the material covered in these statements in its Response to Applicants' Motion for Summary Disposition of Contention 8 and the affidavits attached thereto. As noted therein, the Staff supports Applicants' Motion; the Staff does not challenge any of the Statements proffered by the Applicants.
