Dear Sir:

In response to the report of Inspec tion No. 70-398/85-01, we submit the following information:

We were aware that our License No. 08-00566-05 did not authorize possession of the spent fuel pellets.

Since receipt of the material in 1980, the material has been listed in our special nuclear materials (SNM) i nventories and accounted for as SNM.

The byproduct materials license reference on the internal document was an oversight that we felt could be dealt with by a pen-and-ink change to reference our license No. SNM-362.

We based our assumption on the single reference we found in 10CFR Part 70 concerning spent fuel, i.e.,

10 C FR7 0.1 ( c ), which cites Part 72 as regulating spent fuel in independent spent fuel storage installations (ISFSI);

on 10CFR Part 72, i.e.,

10 CF R7 2.2( a ) and 10 CF R7 2.3( m), which define ISFSI's so as to exclude our facility; and on the provisions of our License SNM-362 which provides for SNM in any form and in sealed form, either authorization providing sufficient quantity allowances.

Nonetheless, following the inspec to r's instructions and in coor-dination with the reviewer of our license renewal / consolidation request, we have submitted a request for authorization' to store the material by way of a specific line entry notation.

We antic-ipate that, on receipt of this permission, arrangements will be made to dispose of the spent fuel pellets.
