DAIRYLAND POWER COOPERATIVE LA CROSSE BOILING WATER REACTOR (LACBWR)

PROVISIONAL OPERATING LICENSE NO. DPR-45 APPLICATION FOR AMENDMENT TO LICENSEE

(3) 10 CFR 50, Section 50.90.

Gentlemen:

In Reference 1, DPC proposed Technical Specifications on Emergency Core Cooling Systems, which substituted specifications in the standard format for existing specifications. The NRC reviewed the submittal and has requested a revision to the DPC proposed requirements. During telecons on August 14 and 22, 1985, DPC and NRC representatives agreed on additions to the proposed specifications. The NRC requested that DPC submit a revised license amendment application for this change. Therefore, in accordance with the provisions of Reference 3, an application to amend Provisional Operating License NO. DPR-45 for the La Crosse Boiling Water Reactor is hereby filed with three (3) signed e

original applications, together with thirty-seven (37) copies. A copy of the og revised pages containing the proposed Technical Specifications is attached.

- L The original submittal neglected to request deletion of Sections 2.4.7 and 5.2.8, which are superceded by the proposed Sections 4/5.2.23.

Reference 2 requested deletion of Section 5.2.8.

This letter requests deletion of Section (D o 2.4.7.

Also, the applicable conditions for low pressure core spray have been

simplified and made more stringent.

p;T gg We have reviewed the hazards considerations referenced in 10CFR50 con.L Sections 91 and 92 and have determined that with these criteria no significant hazards result from these proposed amendments.

10CFR50.92 (c)(1-3) provide the questions for review of significant hazards considerations. They are repeated here for reference.

(1) Involve a significant increase in the probability or consequences of an accident previously evaluated; o r (2) C reate the possibility of a new or different kind of accident from any accident previously evaluated; o r (3) Involve a significant reduction in a margin of safety.

The proposed change adds requirements to and clarifies the bases of the proposed LACBWR Technical Specifications, so it is more stringent. The only deletion is that of redundant material. Therefore, this' license amendment results in "no" answers to the three questions in 10CFR50.92 and no significant hazards determination is justified on this licensee amendment in the opinion of the licensee.

As this license amendment application is a revision requested by the NRC to a previous amendment request, it has been determined to be exempt from any fee.
