The attached Statement of Work (S0W) is an update of the original S0W for E7044.
The S0W has been updated to reflect administrative changes since the original S0W and some minor technical changes. The level of effort has been reduced from 3.5 staff years of effort per year to 1.5 staff years of effort. ORNL is requested to submit a revised standard form 189 within 30 days which reflects the changes in the S0W. Since the NRC utilization under E7044 has been at a lower rate than originally projected, the work period has been extended to December 31, 1998.

1.0 BACKGRQUND i
A total of 29 States have formal agreements with the Nuclear Regulatory Commission (NRC), under Section 274 of the Atomic Energy Act of 1954, as amended (AEA), by which those States have assumed regulatory responsibility over byproduct, source materials, and small quantities of special nuclear material (SNM). There are approximately 15,000 radioactive materiallicenses administered by Agreement States, representing i
about 65 percent of all the radioactive licenses issued in the United States.
l The NRC is required by the AEA to periodically review these Agreement States radiation control programs to ensure that they are both compatible with the NRC's rules for the regulation of such materials, and that the State's program is adequate to protect the public l
health and safety with respect to the materials covered by the agreement. Furthermore, l
the NRC is authorized and directed, under the AEA, to cooperate with the States in the formulation of standards for protection against hazards of radiation to assure that State l
and Commission programs will be coordinated and compatible.
NRC also provides technical assistance and training to Agreement States and their staffs.
Technical assistance has ranged from interpreting technical information from license applicants to assistance in State reviews of license applications to assisting in State inspections. State radiation control personnel may attend NRC-sponsored courses to improve their ability to maintain high quality regulatory programs.
2.0 OBJECTIVE The objective of this project is to: (1) assist NRC staff in conducting compatibility reviews of Agreement State regulations; (2) assist NRC staff in compatibility and adequacy reviews of Agreement State programs; and (3) assist NRC staff in developing implementing procedures and other supporting regulatory and program guidance documents for use by the NRC staff in fulfilling its statutorily mandated responsibility under Section 274 of the AEA.
3.0 TECHNICAL AND OTHER SPECIAL QUALIFICATIONS REQUNp l
The contractor shall provide technical expertise in a number of areas, including health physics, civil and materials engineering, hydrogeology, and performance assessment, as well as licensed attomeys who have had experience in regulatory activities, and staff experienced in reviewing and writing policy and procedure manuals.

4.0 ESTIMATED LEVEL OF EFFORT The estimated totallevel of effort required to perform this work is 1.5 staff years per year.
5.0 PERIOD OF PERFORMANCE The period of performance shall be from the offective date of the agreement through 12/31/g8.

6.0 SCOPE OF WORK The contractor shall provide the following types of assistance:
6.1 Task Area 1 - Comoatibility Reviews of Aareement State Reaulations The contractor shall review Agreement State regulations and prepare analyses for use by the NRC in determining whether such regulations are compatible with applicable NRC regulations. NRC criteria for cornpatibility determinations, in effect at the time of the review, shall be used.
The scope of the reviews will depend, in part, on the specific NRC regulation and direction given by the OSP Project Manager. The contractor shall be tasked to perform a review of only one Agreement State regulation or a specific NRC regulation for all Agreement States i
to ensure that States' regulations are all compatible with the NRC regulation.
The contractor shall develop a review protocol for a given NRC regulation that will be used in its reviews of the Agreement States conforming regulation. Upon approval by NRC of the review protocol, the contractor will review and analyze the State rule (s), and prepare a document for use by the NRC staff in making its determination as to the compatibility of the Agreement State (s) regulation (s). When information is inadequate to permit a comprehensive review, a list of questions aimed at eliciting the needed additional information will be prepared by the contractor and will be discussed with the OSP Technical Monitor (TM) before they are transmitted by the NRC to the Agreement State (s).
6.2 Task Area 2 - Comoatibility And Adeauaev Reviews of Aareement State Proarams The contractor shall participate in compatibility and adequacy reviews of Agreement State programs. The scope of the reviews willinclude, but may not be limited to, paper audits of and site visits to Agreement States radiation control program offices to review bconsing, inspection, compliance, and enforcement actions taken by the Agreement State.
This task activity also could include accompaniments by the contractor on Agreement State inspections. In addition the reviews may include evaluations of the Agreement State program using Management Directive 5.6, " Integrated Materials Performance Evaluation Program (IMPEP)."
6.3 Task Area 3 - Develooment Of Reaulatorv And Pronram Gtudence Documents For Use Bv The NRC Staff in Fulfillina its Statutory Rannonsibility Under Section 274 Of The AEA The contractor shall assist the NRC staff in the development of implementing procedures and other supporting regulatory and program guidance documents for OSP staff to use in fulfilling NRC's statutory responsibility under Section 274 of the AEA. This task area includes providing an independent review, or supporting NRC review, of existing policy guidance from the Commission on: (1) the implementation of Section 274 contained in
" Criteria for Guidance of States and NRC in Discontinuance of NRC Regulatory Authority and Assumption thereof-by States Through Agreement," dated 1/23/81, amended 7/16/81 and 7/23/83; and (2) Management Directive 5.6, " Integrated Materials Performance Evaluation Program (IMPEP)," and providing recommendations whether to revise or supplement this guidance. Other program guidance and implementing procedures documents that may be assigned to the contractor include reviewing and suggesting updates to the OSP Internal Policy and Procedures Manual and the development of supporting implementing procedures.
l 7.0 WORKING PROCEDURES l
The scope of work for each required task will be defined and funding provided via an NRC Form 173 as noted below. The NRC has designated a Project Manager who will be l
responsible for the overall technical direction of this project (see Section 11.0 below). A l
Task Order Technical Monitor will, in turn, be assigned to each specific task and will be responsible for monitoring the technical work for that task.
When specific work requirements are identified, the NRC will issue Task Orders in the form of Standard Orders for DOE Work (NRC Form 173). Each Task Order will specify all pertinent information regarding the work to be performed including the following, as l
applicable:

- a. Statement of Work to include Background and Objective
- b. Deliverables and Schedules
- c. Estimated Level of Effort and Period of Performance
- d. Technical Reporting Requirements
- o. Meetings and Travel f.
NRC Furnished Materials
- g. Apphcable Special Provisions
- h. Total Task Order Amount After issuance of a Request for Proposal, the contractor shall provide a written Task Order proposal. That proposal shall provide the following:
- a. A discussion of the contractor's understanding of the scope of work requirements and the proposed method of approach to meet the objectives of the work order.
- b. If applicable, how any special provisions will be accommodated.

8.0 REPORTING REQUIREMENTS l
8.1 Monthly Letter Status Renort (MLSR)

A Monthly Letter Status Report (MLSR) shall be submitted by the 20th day of each month i
with distribution as stated in Section 8.3. The MLSR shallinclude the information j
apecified in Exhibit 12 from Handbook 11.7, "NRC Procedures for Placement and i
j Monitoring of Work with the Department of Energy."
8.2 Technical Reports Unless specified otherwise in individual Task Orders, the contractor shall prepare draft and final formal technical reports for each task described in Section 6.0 above. These reports shall be prepared in accordance with NRC Management Directive and Handbook 11.7, "NRC Procedures for Placement and Monitoring of Work with the Department of Energy,"
Part X.B.4, or as directed in the individual Task Orders. They shall be edited and reviewed by the contractor and checked in accordance with the quality assurance requirements addressed in Section 12.0 of this SOW.
Within 30 days of receipt of each draft task report, the OSP PM will provide comments for use in the final task report. These comments will identify potential problem areas, discrepancies, and technical insights on the draft report. A camera ready copy and an NRC-compatible, electronic media copy of the final task report shall be prepared within 30 days from receipt of NRC draft report comments.

The number, purpose, and location of meetings and travel will be described in individual Task Orders. All travel associated with this SOW shall be approved in writing by the OSP PM in advance. All such travel shall result in trip reports, which may be issued separately or as port of the next monthly letter status report. Copies of separately issued trip reports shall be submitted in accordance with Section 8.3 within 15 days of the completion of the travel.
No foreign travelis envisioned in connection with this project.
10.0 NRC FURNISHED MATERIAL Within 10 days from the effective date of each Task Order, or as specified in the specific Task Order, the OSP TM will provide any documentation necessary to complete the assigned work.

The OSP PM is the focal point for all contract related activities. All work assignments and j
program funding actions are initiated by the OSP PM. All proposed work scope or schedule changes must be processed through the OSP PM.
The OSP TM is responsible for providing technical guidance and interpretations of the j
technical aspects of regulatory requirements. All work products must be reviewed and approved by the OSP TM before they are submitted as final documents. The OSP TM is l
not authorized to unilaterally make changes to the approved work scope or schedule or give any direction that would increase costs over approved levels.

Directions for changes in cost or period of performance will be provided by the DOE Operations Office after receipt of an appropriate Standard Order for DOE Work (NRC Form 173). If the contractor receives guidance which is believed to be invalid under the criteria

cited above, the OSP PM shall be immediately notified. If the OSP PM and the contractor are unable to resolve the question within five days, the DOE Operations Office shall be i
notified.
12.0 QUALITY ASSURANCE l
12.1 For all draft and final reports delivered under this agreement, the contractor shall assure that an independent review and verification of all numerical computations and mathematical equations and derivations are performed by qualified personnel other than the original author (s) of the reports. If less than 100 percent are verified / checked (such as might be the case when there are a large number of routine, repetitive calculations),
written approval must be obtained from the OSP PM. Computer-generated calculations will not require verification where the computer program has already been verified. The OSP PM has the option of auditing all documentation including project correspondence, drafts, calculations and unrefined data.
12.2 Unless directed by the OSP PM, all reports, including those which do not contain numerical analyses, must be reviewed by the contractor's management and approved with two signatures, one of which is a level above the program manager.
12.3 Revisions for the reports will be issued with a section that includes the date of the revisions, the reason for the revisions, and the scope of all changes made since the issuance of the first approved report.
12.4 NRC has the option of appointing a Peer Group to review the draft report and make changes to the final report. The contractor may recommend candidates for the Peer Group for approval by the OSP PM. In the occasion of dissent in the content of the final report, the dissenting party will have the option of stating its viewpoints and findings in a section of the report.
13.0 DOE ACQUIRED MATERIAL The OSP PM must be notified prior to acquisition of any capital, ADP, or word processing equipment. Prior to purchase of property with NRC funds, DOE shall conduct utilization reviews of DOE and other appropriated sources of excess and surplus property. Property identified during these reviews that meet NRC project needs shall be transferred to the project in lieu of purchase. DOE shall monitor MOU property (as defined in Part Vill of NRC Management Directive and Handbook 11.7.) assigned to the project on a regular basis to identify excess and surplus MOU property. Such MOU property shall be reported to NRC for utilization acreening using the procedures followed for MOU property disposal at project closeout.
i 14.0 DISPOSAL OF PROPERTY Prior to closeout of this project, a reconciled report shall be developed by DOE to record available equipment and material purchased with NRC funds. The report should contain the MOU property description or nomenclature, manufacturer, model number, serial number, quantity, acquisition cost, receipt date, condition code, and DOE or contractor property identification number. The report shall also identify any ongoing or contemplated NRC projects on which the MOU property could be used. If no MOU property is assigned to the project, the DOE shall provide a negative report. Any MOU property requiring special handling for security, health, safety or other reasons shall be noted as part of the report.
This report should be submitted as soon as possible after a project completion or termination decision has been made, but not later than 60 days after the termination date.
The report should be submitted to the Office of State Programs, Attention: Deputy Director.

If these projects are to continue without interruption, SOEW's providing additional funding and/or time extensions need to be received as soon as possible. Compliance with the DOE-NRC Memorandum of Understanding requires us to stop work on any projects with insufficient funding and/or an expired date.
