ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos.: 50-269, 50-270 and 50-287 Oconee Nuclear Station License Nos.: DPR-38, DPR-47 and DPR-55 The following violation was identified during an inspection conducted on August 13 - September 9,198 The Severity Level was assigned in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C).

Technical Specification 6.4.1 requires the plant to be operated and main-i tained in accordance with approved procedures. Chemistry procedure CP/0/A/2005/06A, Determination of E-bar, requires the liquid and gaseous samples to be counted 2 to 4 hours4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br /> after the initial reactor coolant sample 3 has been collected with a recount of the same samples 5 days later to obtain j the activities of'any nuclides which did not show up on the initial count.

i Contrary to the above requirements, calculations and documentation in the

first half of 1985 did not meet procedural requirements in the following instances

j Unit 1 - January 4, 1985: Performance of the 5 day sample recount was not documente Unit 2 - May 21,1985: Performance of the 5 day sample recount was not documente Also, E-bar was calculated based on 45 minutes elapsed time rather than 2 to 4 hours4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br /> as required.

' Unit 3 - June 25, 1985: The recount was performed 4 days after collection rather than the required 5 day .This is a Severity Level IV Violation (Supplement I).

Pursuant to 10 CFR 2.201, you are required to submit to this office within 30

days of this notice, a written statement of explanation in reply, including

admission or denial of the alleged violations; (2) the reasons for the violations if admitted; (3) the corrective steps which will be taken to avoid further

violations; and (5) the date when full compliance will be achieve Security or safeguards information should be submitted as an enclosure to facilitate withholding it~from public disclosure as required by 10 CFR 2.790(d)
