Dear Mr. McGovern:

This is in response to your letter dated November 14, 1996, regarding Nuclear Regulatory Commission License SNM-639 authorizing the use of radioactive material at your Tuxedo, New York, facility. Specifically, you requested that l SNM-639 remain in effect until the completion of the decommissioning of the l facility, which you currently estimate to be by the end of June 1997. The current expiration date of SNM-639 is December 15, 1996.

NRC regulations at 10 CFR Part 70.38(c) state that "Each specific license continues in effect beyond the expiration date if necessary, with respect to possession of special nuclear material, until the Commission notifies the licensee in writing that the license is terminated. During this time, the licensee shall:

(1) Limit actions involving special nuclear material to those related to decommissioning; and (2) Continue to control entry to restricted areas until they are suitable for release in accordance with NRC requirements."

Because Cintichem is actively decommissioning the site and the controls described in the decommissioning plan that wa; reviewed and approved by NRC in January 1992 will remain in place until the terraination of the license, the NRC staff has concluded that the above conditions can be met and, as such, SNM-639 will remain in effect until the completion of decommissioning operations.
