Gentlemen:

This refers to the routine safety inspection conducted by Messrs. J. M. Hinds,

K. A. Connaughton, P. G. Brochman, R. Lerch, M. Ring, D. Hills, T. Reidinger,

D. Williams, M. Farber, B. Burgess, L. Hueter, and C. Gill of this office on

January 1 through March 26, April 6, 9, 10, and 12, 1985, of activities at

Byron Station, Units 1 and 2, authorized by NRC Operating License NPF-37 and

NRC Construction Permit CPPR-131 and to the discussion of our findings with

Mr. R. E. Querio and others of your staff at the conclusion of the inspection.

This also refers to.the management meetings conducted at Byron Station on

January 2, .16 and 30 and February 14 and 27,1985, concerning operating

. performance, schedules,. reportable events, and associated action plans.

Additionally, this refers to the enforcement conference conducted in our

office on April 29, 1985, relating to (1) the operation of Unit I with certain

protection system components not being seismically qualified, and (2) the

. adequacy of the technical review of test results.

The' enclosed copy of our inspection report identifies areas examined during

the inspection and discussed during the enforcement conference. Within these

-areas, the inspection consisted of a selective examination of procedures and

-

representative records, observations, and interviews with personnel.

During this inspection, certain of your activities appeared to be in

violation of NRC requirements, as specified in the enclosed Appendix.

A written response is required. With regard to Item 2, we recognize that

the operator error was identified and corrected by the plant staff before

the technical specification time allowance for corrective action had elapsed;

however, such procedural errors are of concern to us and we therefore request

'

that in your response you thoroughly reflect the remedial measures taken by

both station and corporate personnel to preclude recurrence of such errors.

We carefully considered the need to pursue further escalated enforcement

' actions for those matters discussed during the enforcement conference;

however, based on the lack of safety significance, we have decided to not

,

pursue such actions.

Nevertheless, we believe the issues merit your close

'

examination to determine lessons that can be learned to avoid similar problems

in the future. Along this line, in response to this letter please describe

your actions to assure all of your personnel involved in the review of test

results have been sensitized to the need for thorough, rigorous, and completely

documented reviews of test results.

-The responses directed by this letter (and the accompanying Notice) are

not subject to the clearance procedures of the Office of Management and

Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.

We will gladly discuss any questions you have concerning this inspection.
