Dear Mr. Taylor:

j In response to a request for additional information to Union Electric Company l (UE) regarding UE's proposed technical specification change to allow the i installation of Framatome electrosleeves in the Callaway Plant, Unit I steam generators, UE submitted information from Framatome Technologies, Inc. (FTI),

j by letter dated September 24, 1996, containing proprietary information. In the same letter, UE submitted a nonproprietary version of the information for j placement in the Public Document Room.

In your affidavit dated September 20, 1996, you stated that the proprietary l information should be considered exempt from mandatory public disclosure for l l the following reasons- 1 j "b. The information reveals data or material concerning FTI research i or development plans or programs of present or potential l competitive advantage to FTI.

t l c. The use of the information by a competitor would decrease his i expenditures, in time or resources, in designing, producing or j marketing a similar product.

l l d. The information consists of test data or other similar data j concerning a process, method or component, the application of which results in a competitive advantage to FTI.

e. The information reveals special aspects of a process, method, component or the like, the exclusive use of which results in a competitive advantage to FTI.
f. The information contains ideas for which patent protection may be i sought."

We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains proprietary cosanercial information. s)

' Therefore, the version of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

i Withholding from public disclosure shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need i arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the i appropriate agreements for handling proprietary information. l If the basis for withholding this information from public inspection should
