Dear Ms. Bell:

This is in further response to your letter dated August 6,1984, in which you requested, pursuant to the Freedom of Information Act (FOIA), all records relating to the receipt, analysis (legal and technical), and denial of one or more "Show Cause" petitions filed by Cynthia Stewart on behalf of Jacksonians for Livable Energy Policies (JULEP) requesting action on the Grand Gulf plant.

The three documents listed on the enclosed Appendix C are subject to your request. Document one is being released in its entirety and is being placed at the POR in file folder F01A-84-665. Portions of document and(7)(A)oftheF0IA(5U.S.C.552(b)(5)and(pursuanttoExemptions(5) three are being withheld from public disclosure 7)(A)) and 10 CFR 9.5(a)(5) and (7)(1) of the Comission's regulations.

Document two is being withheld in its entirety pursuant to Exemption (7)(A) of the F0IA (5 U.S.C. 552 (7)(A) and 10 CFR 9.5(a)(7)(i) of the Comission's regulations.

Portions of Document 3 contain predecisional advice, opinions, and recomendations of OIA to the Comissioners. Release of the information would tend to inhibit the open and frank exchange of ideas essential to the deliberative process.

Documents 2 and 3 are investigatory records compiled for law enforcement purposes. The production of them would interfere with the referral of part of the investigation by OIA to the Justice Department. Disclosure of such sensitive information might compromise the ability or willingness of the Department to undertake its own further investigation. The nonexempt portions of document three are being placed in the PDR and will be filed in folder F01A-84-665.

Pursuant to 9.15 of the Comission's regulations, it has been determined that the infomation withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The person responsible for the denial of documents two and three is Ms. Sharon Connelly, Director, Office of Inspector and Auditor.

As provided in 10 CFR 9.15, any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."
