PROVISIONAL OPERATING LICENSE NO. DPR-45 APPLICATION FOR AMENDMENT TO LICENSE

Dear Mr. Zwolinski:
In Reference 1, DPC proposed Technical Specifications in response to Reference 2.
Included in Reference 1 were proposed specifications on site flooding.
l The NRC reviewed the submittal and requested revision of the DPC proposed requirement. During telecons in March-May 1985, DPC_and NRC representatives j
agreed on a modified, more restrictive version of~the proposed specification on site flooding. Therefore, in accordance with the provisions of Reference 3, an application to amend Provisional Operating License No. DPR-45 for the La Crosse Boiling Water Reactor is hereby filed with three (3) signed original applications, together with thirty-seven (37) copies. A copy of the revised page containing the site flooding Technical Specification is attached.
l-l The revised proposed specification is as follows:
If the plant is in CONDITION 1, 2, or 3 and the Mississippi River level adjacent to the plant reaches 639.2' and is predicted to exceed 640', conrnence reactor shutdown and be in CONDITION 4 prior l
to the river level exceeding 640'.
f The basis-of the above is that 640 feet is the floor elevation of the turbine building and cribhouse. The maximum rate at which the river level is 0

.If plant shutdown is started at 639.2 feet, the river will not exceed 640 feet 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> later. The plant can be placed in cold shutdown in a 12-hour period.
This specification, therefore, requires the plant to be in cold shutdown before flooding above the grade floor of the plant starts.
If, however, flooding above 640 feet is not predicted, the plant will not be required to shut down unnecessarily.
Finding of no significant hazards We have reviewed the hazards considerations reference in 10 CFR 50, Sections 91 and 92 and have determined that with these criteria no significant hazards result from these proposed amendments. 10 CFR 50.92 (c) (1-3) provide the questions for review of significant hazards considerations. They are repeated here for reference.
(1) Involve a significant increase in the probability or consequences of an accident previously evaluated; or (2) Create the possibility of a new or different kind of accident from any accident previously evaluated; or (3) Involve a significant reduction in a margin of safety.
The proposed change adds new requirements to LACBWR Technical Specifications.
No existing requirements are downgraded or modified in any way. Therefore, this license amendment results in "no" answers to the three questions in 10-CFR 50.91 and no significant hazards determination is justified on this licensee amendment in the opinion of the licensee.
As this license amendment application is a revision requested by the NRC to a previously submitted amendment request, it has been determined to be exempt from any fee.
