Dear flepresentative Mitchell:
I am responding to your September 20,1996, letter to Chairman Jackson, Commissioners Rogers and Dieus, and Judges Moore, Cole, and Shon, expressing concerns about the proposed Louisiana Energy Services (LES) uranium enrichment plant in Claiborne Parish, Louisiana.
Before granting a license for this type of facility, the Nuclear Regulatory Commission conducts a safety review and an environmental review, and holds an adjudicatory hearing which is open to the public. The NRC technical staff has completed its safety and environmental reviews, and the matter was presented to the NRC Atomic Safety and Licensing Board for the hearing phase of the licensing process. Participants in the public hearing included the applicant, the NRC technical staff, the State of Louisiana, and a Claiborne Parish intervenor group, Citizens Against Nuclear Trash, which opposes licensing of the f acility. At the hearing, which was conducted in Shreveport, Louisiana, in July 1994, and March 1995, the Licensing Board heard testimony on many of the issues raised in your letter. The Licensing Board issued a partialinitial decision on certain safety matters on April 26,1996. A decision by the Licensing Board on the matters raised in your letter, which may be subject to Commission review, is pending.
