.This is to inform you of our receipt of the Federal Emergency Management Agency's (FEMA) approval of the State of Wisconsin's emergency' response plan as well as associated local plans related to the Lacrosse Boiling Water Reactor. These plans have been reviewed and approved by FEMA Region V and the FEMA Headquarters. A copy of the letter dated May 10, 1985, from Mr. Samuel W. Speck, Associate Director, State and Local Programs and Support, FEMA to Mr. William J. Dircks, Executive Director for Operations, U. S. Nuclear Regulatory Commission is enclosed for your information.

Please note that this approval contains a condition that the adequacy of the public alerting and notification system must be verified according to the FEMA / Nuclear Regulatory Commission joint criteria as listed in NUREG-0654/

FEMA-REP-1 (Revision 1), Appendix E.

Also note that this' letter does not address the approval of the State of Minnesota's emergency response plan or' associated local plans in the State of Minnesota.

Pursuant to 10 CFR 50.54(s)(3) the Nuclear Regulatory Commission approves the State of Wisconsin and local emergency plans in the State of Wisconsin around l

the Lacrosse Boiling Water Reactor based on a review of the FEMA findings.

The Safety Evaluation Reports (50-409/82-15 and 50-409/84-13) issued by Region III on November 23, 1982, and December 4, 1984, concluded that the

! licensee, Dairyland Power Cooperative, had an emergency plan for the Lacrosse 1 Boiling-Water Reactor that met the planning standards of 10 CFR 50.47(b) and the requirements of Appendix E to 10 CFR Part 50.

Thus, both the onsite plan, and the offsite plans for the State of Wisconsin and associated local governments int he vicinity of the Lacrosse Boiling Water Reactor are NRC and FEMA approved with the one condition for the Wisconsin offsite plans as noted in this letter.

Dear Mr. Dircks:

In accordance with the Federal Emergency Management Agency (FEMA) rule, i 44 CFR 350, the State of Wisconsin submitted its State and associated local plans for radiological emergencies related to the Lacrosse Nuclear Power Plant to the Regional Director of FEMA Region V for FEMA review and approval.

The Regional Director forwarded his evaluation of the Wisconsin State and local plans to me on August 30, 1984, in accordance with section 350.11 of the rule. His submission included an evaluation of the exercises conducted on October 21, 1981, August 3, 1982, and June 19, 1984, in which the State demonstrated its capability to implement its plan dated August 1983. A report of the public meeting held on November 10, 1981, which explained the site-specific aspects of the State and local plans, was also included.

Based on an overall evaluation, I find and determine that, subject to the condition stated below, the State and local plans and preparedness for the Lacrosse Nuclear Power Plant are adequate to protect the health and safety of the public in that there is reasonable assurance that the appropriate protective measures can be taken offsite in the event of a radiological emergency. However, whila there is a public alert and notification (A&N) system in place and operational, this approval is conditional on FEMA's verification of the A&N system in accordance with the criteria of appendix 3 of NUREG-0654/ FEMA-REP-1, Rev. 1.
