WOLF CREEK NGS/ ALLEGED INTIMIDATION OF DANIEL . .

INTERNATIONAL llECHANICAL QC INSPECTORS (4-82-016)

Enclosed is the Office of Investigations' final report on this subject.

The investigation established that some acts of intimidation may have taken place prior to the initiation of the investigation, but did not uncover evidence that the acts were taking place at the time of the investigation.

It will be necessary to determine the validity of the NCRs that were allegedly improperly voided before arriving at a final determination regarding the earlier acts of alleged intimidation. It should be noted that even if the NCRs were properly voided, this would only be one factor, albeit significant, to disprove intimidation. It is my understanding that copies of these NCRs have already been provided your staff which is examin-ing this issue. Thus, 01 contemplates no further action on this particular subject.

Additionally, several of the QC ins'pectors interviewed advised that due to the attitudes of their supervisors regarding the writing of NCRs they verbally told craft' employees of deficiencies rather than write NCRs. A few QC inspectors stated in spite of this they still felt free to

. write NCRs. In DI's ' view, the weight of the evidence indicates that Daniel International practices and procedures did have a negative impact on the' writing of NCRs by the inspectors interviewed.

Finally, present QC inspectors were almost unanimous in stating the afore-mentioned problems were alleviated by the firing or transfer of several former supervisors.

Neither this report nor transmittal memorandum may be released outside the NRC without the pemission of the Director, OI. Internal access and disse:aination should be on a need and right to know basis.

These allegations were brought to Region IV's attention by the Senior Resident Inspector, Tom Vandel.
