SUBJECT: NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL
PENALTY: EA 85-38
(NRC INSPECTION REPORT NOS. 50-259/85-08, 50-260/85-08 AND
50-296/85-08)
A routir.e inspection was conducted on February 4, 1985, of activities
authorized by Nuclear Regulatory Connission (NRC) Operating License Nos. DPR-33,
'
DPR-52,~and DPR-68 at the Browns Ferry Nuclear Plant. One safeguards violation
was identified in which vital equipment was not afforded the level of protection
specified in the Physical Security Plan. A similar safeguards violation was
addressed in our letter of September 1,1983. The findings of this inspection
were discussed with members of your staff during an Enforcement Conference held
in the Region II Office on February 7, 1985. An additional Enforcement
Conference was held at your request on March 14, 1985.
To emphasize the need to increase the effectiveness of the management of your

security program I have been authorized, after consultation with the Director,
Office of Inspection and Enforcement, to issue the enclosed Notice of Violation
'and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand
!'
Dollars ($50,000) for the violation described in the enclosed Notice.
In
accordancewiththe"GeneralStatementofPolicy(andProcedureforNRC1985),theviolationd
Enforcement Actions," 10 CFR Part 2. Appendix C
'
in the enclosed Notice has been categorized as a Severity Level III violation.
The base civil penalty amount for a Severity Level III violation is $50,000.

The escalation and mitigation factors in the Enforcement Policy were considered.
l
The base civil penalty could have been escalated by 50 percent because of
your prior poor performance in the implementation of your Physical Security Plan.
!
However, because of the immediate corrective actions taken and proposed following
!
this event, I have decided not to escalate the proposed civil penalty.

You are required to respond to this letter and should follow the instructions
saecified in the Notice when preparing your response.
In your response, you
s1ould place all Safeguards Information as defined in 10 CFR 73.21 only in
enclosures, so that your letter may be placed in the Public Document Room.
In
your reply, you should describe those actions taken or planned that are designed
to increase the effectiveness of the management of your security program,
particularly with regard to fully implementing and maintaining in effect all
provisions of your Physical Security Plan. Your written reply to the Notice
and the results of future inspections will be considered in determining whether
further enforcement action is appropriate.
The material enclosed contains Safeguards Infomation as defined by 10 CFR 73.21,
and its disclosure to unauthorized individuals is prohibited by Section 147
of the Atomic Energy Act of 1954, as amended. Therefore, with the exception
of the cover letter and the report cover page which is an inspection summary,
the material will not be placed in the Public Document Room.
The responses directed by this letter and the enclosure are not subject to the
clearance procedures of the Office of Management and Budget issued under the
Paperwork Reduction Act of 1980, PL 96-511.

discuss them with you.
