1. Justification Sections 40.64(b), 70.53(a)(1) and 150.17(b) 10 CFR Section 40.64(b) currently requires each NRC licensee who is authorized to~ possess at any one time and location more than 1,000 kilograms of uranium or 3

thorium, or any combination thereof, to complete and submit to the NRC within thirty days after September 30 of each year a statement of his source material inventory. 10 CFR Section 150.17(b) imposes the same requirement on Agreement State licensees. 10 CFR Section_70.53(a)(1) currently requires each licensee who is authorized to possess at any one time and location special nuclear material in a quantity -totaling more than 350 grams of contained uranium-235, uranium-233, or plutonium, j - or any combination thereof, to complete and submit to the NRC Material Balance Reports.(742) and a statement of the composition of the ending inventory (742C) within thirty days of March 31 and September 30 of each year. 1 The collection and recording of data for inventory purposes is a continuing - process that the licensee carries out throughout the year for the licensee's internal records. At the specified times for inventory reports, the licensee L

simply submits the accumulated data from the licensee's records, based either on book inventory or on data from a physical inventory-taking, to NRC in the report. The requirenent to report within thirty days of the ending data is a reasonable measure to ensure timeliness in receipt of inventory data by NRC in order to maintain material accountability under its statutory responsibility ~ under the Atomic Energy Act to ensure protection of the common defense and security. Moreover, the US/IAEA Safeguards Agreement specifies that reports are to be submitted within 30 days following a physical inventory taking.

Need for'and Practical Utility of the Information Collection As the result of a reevaluation of the safeguards data collection and pro-cessing requirements, NRC has determined that with the exception of licensees reporting under the US/IAEA Safeguards Agreement and reporting composition of ending inventory by persons licensed to operate nuclear reactors, the requirements to report inventories on Material Balance Reports can be deleted. Instead, the NRC would computer generate, for each licensee, an inventory report based on mate-rial transaction reports submitted to the NRC on Form 741 for special nuclear material and foreign origin source material. Attached are a DOE /NRC Form 742 to be completed by licensees who report under the US/IAEA Safeguards Agreement (10 CFR Part 75), a copy of a sample generated 742 report,-and a DOE /NRC Form 742C to be completed by licensees who report composition of ending inventory under .Part 75 and those licensed to operate nuclear reactors. (In a separate rule-making action effective July 15, 1984, the requirement to report domestic trans-fers of U.S. origin source material was deleted. Only imports, exports, and domestic transfers of foreign origin source material-are currently reported to the transaction data base.) Revised Section 40.64(b) would require each licensee who is authorized to possess more than 1,000 kilograms of uranium or thorium or any combination of uranium cr thorium to verify and update a statement of material balance generated by the Commission provided the database indicates that the licensee has had foreign origin source material during the period of the report. The statement will contain data concerning source material of foreign origin received, possessed, transferred, consumed, disposed of, or lost by the licensee. This information is needed to provide to the Australian and Canadian Governments a periodic report showing the inventory of all materials in each U.S. facility that is subject to their respective Bilateral Agreements. The statement will be generated by the Commission as of September 30 of each year and mailed to the licensee by October 15 of each year. The licensee will verify and update the statement and, if any change is necessary, submit a statement indicating the updating changes to the Commission by October 31. Revised Section 150.17(b) imposes the same requirement on Agreement State licensees as revised Section 40.64(b) above. Revised Section 70.53(a)(1) would require each licensee who is authorized to possess more than 350 grams of special nuclear material (uranium-235, uranium-233, or plutonium) in any combination to verify and update a statement of material balance generated by the Commission concerning special nuclear 5 material received, produced, possessed, transferred, consumed, disposed of or lost by the licensee.. This information'is necessary to the domestic inspection program and is needed to provide to the Australian and Canadian Governments a periodic report showing the inventory of all materials in each U.S. facility that is subject to their respective Bilateral Agreements. The Statement will be generated by the Commission as of March 3f and September 30 of each year and mailed to the licensee by April 15 and October 15. The licensee will verify and update, and if any change is necessary, submit a statement indicating the updating changes to the Commission by April 30 and October 31. In. addition, persons licensed to operate nuclear reactors are required to prepare and submit a statement of composition of ending inventory (Form 742C)- as of March 31 and September 30 of.each year and file within thirty (30) days after the c..d . the period covered by the report. .This information is necessary to the domestic inspection program and cannot be generated by the Commission from other data sources,

c. Duplication of Other Collections of Information In general, information required by the NRC in reports concerning.inven-tory of nuclear materials does not duplicate other Federal information collec-tion requirements and is not available from any source other than licensees.

Portions of the needed information might also be contained in other infonna-tion submittals to the NRC or other Federal agencies. However, duplication, if any, is slight, and the collection of this information by use of specified I forms and other-required reports is the most effective and least burdensome means of obtaining the information. 2. Description of. the Information Collection a.

Number and Type of Respondents The-amendment affects approximately 350 NRC and Agreement State licensees of which approximately 150 are small independent industrial manufacturers, each with an estimated annual gross income of less than $1 million and a staff of fewer than 500 people. b.- Reasonableness of the Schedule for Collecting Information Affected SNM licensees wil1 be required to review and verify a computer gen-erated statement twice yearly. This schedule is _ reasonable because the review and verification will coincide.with a physical-inventory taking, if applicable. Affected source material licensees will. review and verify the statement once per year based on. book inventory. c. Method of Collecting the Information The review and verification of the Commission generated report is the least burdensome method of obtaining the objective because the review and verification at the licensee site will in most cases eliminate the need for submission of a . report to the C_ommission except when adjustments are necessary. t ~ r -s-i. r, d. Adequacy of the Description of the Information -Licensees presently submit a report to the Commission with the required 'information. The computer generated report that the licensees will be required to, review and verify will be a facsimile of the report currently submitted. The schedule for submission to the licensee is stated in the regulation as is the schedule for the licensee to submit any changes, if _necessary. ~ e. Record Retention Period None. Any material balance reports, inventories, forms, and transaction reports are retained, if at all, pursuant to 10 CFR Sections 40.61(a), 70.51(b), and 75.21 through 75.24, all of which have been previously approved by OMB. f. Reporting Period Persons licensed under Parts.40 and 150 are required to revi.ew and verify a Commission generated statement of inventory once a year. Part 70 licensees are required to review and verify a statement of inventory twice yearly. If changes are necessary, the licensee will submit a statemen't indicating the updating changes to the Commission. Otherwise, no submission to the Commission is necessary. g. Copies Required to be Submitted If changes are to be made to the Commission generated statement, one copy with updating changes will be submitted to the Commission. Otherwise, no response is necessary. .3. Estimato cf Burd:n .a. Estimated Hours Required to Respond to the Collection The burden for review and verification of each statement is estimated to be one hour. A total of approximately 450 statements are expected to be reviewed and verified annually. Approximately 40 Part 40 licensees will review and verify one statement each year; approximately 200 Part 70 licensees will review and verify 2 statements each year; and approximately 10 Part 150 licensees will review and verify one statement each year. Thus the total resulting burden for all licensees will be 450 hours. The decrease since the last clearance is a result of the reduced num~ber of licensees required to submit' inventory data and the reduction in time resulting from the change in the method of collection. The reduction in the use of NRC Forms 742 and 742C resulting 'from these revisions will be reflected in OMB clearance numbers 3150-0004 and 3150-0058. b. Estimated Cost Required to Respond to the Collection The annual cost to each Part 40 and 150 respondent to comply with the re-quirement is estimated to be $60. The annual cost to each Part 70 respondent is estimated to be $120. The total annual cost to all affected licensees is estimated to be $27,000. This represents a ' reduction of 750 hours or $45,000 annually. c. Source of Burden Data This data is based on informal consultations by the staff with a small number of typical licensees and analysis of actual submissions of inventory reports during CY 1983. Cost data is based on $60 per hour.....

It is not possible to suballocate this cost to individual forms.
