SUBJECT: NRC INTEGRATED INSPECTION REPORT 50-348/96-07 AND 50-364/96-07.

NOTICE OF VIOLATION AND NOTICE OF DEVIATION

Dear Mr. Morey:

On August 31. 1996, the NRC completed an inspection at your Farley Nuclear

Plant (FNP) facility. The enclosed report presents the results of that

inspection.

During the six-week period covered by this ins)ection period. your conduct of

activities at FNP was generally characterized )y safety-conscious operations.

sound engineering and maintenance practices, and careful radiological work

controls. However, a violation of NRC requirements and a deviation from prior

commitments were identified. We are particularly concerned about the

deviation that was identified regarding your failure to accomplish important

commitments made to the NRC. These commitments were a fundamental part of our

basis for approving your Facility Operating License amendment request to

eliminate the Technical Specifications surveillance requirements for response

time testing of critical pressure sensors. It is essential that you ensure

all commitments of this nature are accomplished.

The violation and deviation are cited separately in the enclosed Notice of

Violation and Notice of Deviation. and the specific circumstances surrounding

them are described in detail in the enclosed report. Please note that you are

required to respond to this letter and should follow the instructions

specified in the enclosed Notices when preparing your response. Furthermore,

when you respond to the Notice of Violation related to inadequate as-built

configuration control cited in NRC inspection report 50-348. 364/96-10. you

are also required to address the examples identified in Section El.2 of this

report. The NRC will use your responses, in part. to determine whether

further enforcement action is necessary to ensure compliance with regulatory

requirements.
